The Maximum time that an arrested suspect can be kept in custody is 24hrs before a Review takes place by an Insp; Upon arrival at a police station a Custody Record will be opened; Plus a PACE Clock will have started ie a period of time that a person is & can remain in custody; (Max 96hrs) The Custody Clock starts upon arrival at the first police station an arrested person attends; The Insp has to be convinced that the Investigation is/has been carried out expeditiously; IF? More time is required to carry out further Enq’s Interviews & a likely charge to take place then the Insp will ask a SUPT to grant an extra authority to detain for up to 36hrs Thereafter IF? Further time required normally for a Murder or Complicated Investigation; the police will have to get a Magistrate to grant further extensions of 24hrs up to a Maximum 96hrs where a suspect is to be charged or released; Police will always avoid keeping someone in custody right up to the 96hrs as that limits them to carry out any further interviews; Police will often Bail a suspect ASAP if they know that further often extensive enquiries are to be carried out; Bail is normally granted for 28 days Initially but can & most often is extended sometimes fir many months; The police must keep in close contact with the CPS (Crown Prosecution Service) to ensure that an investigation is progressing; When there is sufficient evidence obtained that supports a Charge(s) the police will share this evidence with the CPS Lawyer who will then decide on what charges should be laid; Quite often it is the CPS who insist on further Bail if they feel that there is insufficient evidence to charge; Police will try & do their best Not to keep someone in custody as best as possible; a person will be kept in custody if the offence is deemed serious or the person is likely to abscond or interfere with witnesses; the Magistrates the following court date normally the next morning or if it’s a Saturday afternoon/evening Monday morning will then decide to Bail that person or to further remand them; IF? A Suspect is further remanded in custody they can go to a Judge in Chambers to ask him/her to further consider granting Bail; A person arrested under the Terrorism Act Can be kept in custody for up to Two Weeks; this is obviously because of the serious nature of the alleged offence(s)

Folks before too many people get too excited; an arrest is made when an allegation has been made; it’s to give an alleged suspect an opportunity to answer questions & in no way gives any Indication that a person will in fact be charged with any offence(s) it’s called part of the process of investigating an alleged crime(s) A person will more often be released on Bail conditional or otherwise or released under Investigation ie further enquiries will need to be carried out; ie further witnesses to be interviewed or to read through emails etc; It will be at the conclusion that the police will seek advice from the CPS as to whether there is enough evidence to charge; if required prior to such taking place the police may call/invite a Suspect to attend a police station for a further interview; Once a person has been released on Bail or under Investigation they won’t be further arrested at their hind address but will attend a police station for such; All those arrested are conveyed to a police station given their rights asked about their welfare & if they understand why they have been arrested; A Custody Record will be opened; a suspect placed in a cell to await the attendance of a solicitor; the solicitor will be given a brief resume of why their client has been arrested etc; If Charged with an offence a photograph will be taken a DNA test & fingerprints; The CPS will often have made a decision to charge or If? Insufficient evidence release the Suspect as in No Further Action will be taken in this matter; That’s called released without charged IF? Charged then a suspect will be bailed to appear at court on a given tame & dare; A Full hearing at the Magistrates or Crown Court will be heard with the suspect being released on Bail & quite often with restrictions or unconditional bail with the only requirement thats they attend court for their hearing & thereafter a trial!
