At the time of posting, I fully believed the information to be accurate. There was ZERO malice, and under the Actual Malice Standard (New York Times Co. v. Sullivan), a journalist is protected if they believe the info was true at the time and correct the record once the error is found. Protected Opinion: Every other post they take issue with is my protected opinion and editorial theory. In America, you cannot sue someone for having an opinion you don't like. The Preservation Trap: Their own letter demands I "preserve all evidence" to prevent the "spoliation of evidence." I CANNOT delete my posts even if I wanted to—they are now part of the official legal record. The Gift of Discovery: If TPUSA wants to take me to court, bring it. I welcome the Discovery process.
