🚨BREAKING: In yet another attack on national competence and sovereignty, the EU tells Member States they are not entitled to protect biological sex in their national constitutions.
In a ruling about Bulgarian legislation, which recognises the truth of the biological sex binary, the Court of Justice of the EU plainly stated today that transgender ideology and a person's "lived gender identity" must be given priority over such national legislation.
The Court ruled that "EU law precludes a court from being bound by its constitutional court’s interpretation where that interpretation impedes the application of EU law as interpreted by the Court”.
The case was initially registered as “Shipov”, because that was the surname appearing in the applicant’s civil-status records. During the proceedings, the applicant used the feminine “Shipova”, which is what the CJEU used in its judgment today—showing the ideological bias of the Court on this issue.
When courts use back-door arguments, such as free-movement law, to reshape national civil-status rules, as they did in this case, it raises serious concerns about both democratic accountability and the protection of biological sex in law.
