Those are narrow exceptions—'true threats,' incitement to imminent lawless action (Brandenburg v. Ohio), or false alarms causing panic. Kimmel's crude Melania joke isn't even close to those exceptions. I am not defending what Kimmel said. Far from it. But the First Amendment exists precisely to protect speech we hate, including offensive satire. Weaponizing the FCC to threaten Disney's broadcast licenses over it is textbook government overreach and viewpoint discrimination. True conservatives defend the 1A even when it's inconvenient—not just when it suits us.
