A great opportunity to remind ourselves that Article 255 of the Kenyan Constitution requires a referendum for certain crucial constitutional amendments - a direct implementation of Article 1 because: “all sovereign power belongs to the people of Kenya”!

UPDATE: The Constitutional amendment case is scheduled for ruling today before Justice Mugambi. The ruling is expected to address the following issues: 1. Whether the court has jurisdiction to hear the case: Parliament and the AG argue that we should have petitioned Parliament before going to court. 2. Whether the court should issue the conservatory orders stopping the president from signing the bill: Parliament and the AG argue that this is an infringement of the separation of powers. 3. Whether the judge should forward the petition to the CJ for empanelment (a multiple-judge bench): Parliament and the state argue that it is not a big issue.
