The Myth that Reservation is Temporary and needs to be extended every 10 years !!! Initially, coming from reputed lawyers, surgeons, I also, for a moment, thought that Reservation was temporary. But I checked the legal and constitutional position of it. Reservation in political representation (MLAs, MPs, etc), Reservation in Educational Institutions, Reservation in Government Jobs are the three types of Reservations available for SC/ST/OBCs. The extension of time is only for Political representation under Article 334, where the time limit was initially fixed at 60 years. However, by the 95th Amendment, this 60-year period was extended to 70 years. Article 334 is only for Political representation and not for the other two types of reservations. So, to summarize this, · Political Reservation: Time limit is applicable. · Educational Reservation: No upper limit of 10 years prescribed. · Public Services Reservation: No upper limit of 10 years is prescribed. So, only political reservations require amendments every ten years. The Constitution envisages a permanent reservation system in Educational institutions, government jobs, and Civil Services. There is almost no way to remove this. Even though this demand was not included in the final text of the Constitution, Ambedkar had left it to the Scheduled Castes to “invent new ways of getting the same protection” (CAI 1949e). The political reservations were a result of “mutual agreement” between Scheduled Castes and caste Hindus. When it was incorporated into the Constitution, it became akin to a constitutional promise. Though the Constituent Assembly fixed a time limit of ten years on political reservations, Ambedkar himself had prescribed the method of constitutional amendment to extend this time limit, if the situation of SCs and STs does not improve (Ibid). The extension of this time limit since 1960 is in spirit of Ambedkar’s demands.
