Court Gives Nnamdi Kanu Final Chance to Defend Terr+rism Charges or Forfeit Right The Federal High Court in Abuja has given the detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, until November 5, 2025, to open his defence in the terr+rism charges filed against him by the Federal Government or risk forfeiting his right to do so. Presiding Judge, Justice James Omotoso, issued the directive on Tuesday following Kanu’s continued refusal to proceed with his defence, insisting that there was no valid charge currently pending against him. During the session, Kanu, who appeared without legal representation, argued that his detention by the Department of State Services (DSS) was unlawful and that he could not be tried under the repealed Terrorism Prevention and Prohibition Act. He also cited Section 36(12) of the 1999 Constitution, which states that no person shall be prosecuted unless the offence is clearly defined in a written law. The IPOB leader accused the court of disregarding the Supreme Court’s earlier judgment on his extraordinary rendition from Kenya, maintaining that his continued trial violated his fundamental rights. Justice Omotoso, however, advised Kanu to seek the help of lawyers experienced in criminal law or formally appoint a counsel, ruling that the case would proceed in line with the Supreme Court’s order for a retrial. After several failed attempts to persuade Kanu to enter his defence, the judge adjourned the case to November 5, 2025, warning that failure to do so would amount to waiving his right to defence. Kanu has remained in DSS custody since his controversial arrest and rendition from Kenya in 2021. He faces multiple counts of terrorism and related offences, which he insists are politically motivated and rooted in his peaceful agitation for Biafra’s independence.
