DEVELOPING: General Firoz Khan has filed an application before the JHB high Court on an urgent basis to interdict the SAPS from downloading, dissementing, copying data from his devices and subjecting his devices for forensic examination. He has also directed in his court application that his seized cellphone devices and laptops be brought back to him. Khan further wants to declare the "warrantless search" by members of the SAPS at his residence in Houghton unlawful and unconstitutional. @eNCA @Abramjee

@dansmywholename Well, the jurisprudence up to now has taken a very generous interpretation to include *all* activities of judges (active or retired) as requiring consent to sue, except for domestic violence, which is expressly excluded by statute. Ironically, a 1979 case excludes commissions.

The High Court’s interpretation of this provision in the TRC commission case was incorrect. Judges, when chairing commissions, panels, are not exercising judicial such that civil proceedings brought against them would interfere w admin of justice so as to require s 47 permission.

The Magistrate ordered a postponement that clashed with the prosecutor’s diary commitment. Basically threatening the prosecutor “shove it down their throat?” The NPA was silent.
