Can a child from Zina Inherit the father? I have been inundated with tags and several anonymous messages on this question —whether the child from Zina before marriage contract has a right to the father’s inheritance? This question says one thing: the fact that many people are looking for solutions to the mess they created for themselves. This is why I tell two lovers, do Aqd-Nikkah as soon as possible. It is the best solution to prevent Zina. What I want to do in this post is to provide a thorough dissection of the scholarly landscape on this matter, and to state in express terms where I stand on this. First of all, the primary legal obstacle used by the majority of scholars across the four schools of thought is rooted in the firm stance that illicit relations cannot serve as a foundation for family ties. Their foundational principle is clear: النسب لا يثبت بالزنا Lineage is not established through Zina. This position is built on the narration in Bukhari and Muslim where the Prophet (peace be upon him) said: الولد للفراش وللعاهر الحجر The child belongs to the marital bed and for the adulterer is the stone. The majority interpret "the stone" as total deprivation. For them, a child born outside of marriage is legally severed from the biological father in every legal sense. There is no legal name, no custody, and no inheritance. They argue that because the act itself is void and forbidden, it cannot be the source of a legal right. The child is linked only to the mother, and the father remains a legal stranger, regardless of his blood connection or his desire to claim the boy. However, Ibn Taymiyyah and Ibn al-Qayyim challenged this rigid exclusion by looking at the context of the law. They argued that the Hadith about the marital bed was meant to settle disputes between two men claiming the same child. If the mother is not married, there just as it is in this question above, then there is no competing "bed" to protect. Ibn al-Qayyim explained this in Zad al-Ma'ad in the chapter (فصل في حكمه صلى الله عليه وسلم في الغلام الذي تنازع فيه رجلان) He said: واذا لم يكن هناك فراش ينفيه فلا مانع من اللحوق ولا سيما اذا كان الرجل يستلحقه ولا يدعيه غيره When there is no marital bed to negate the lineage, there is no barrier to the child being joined to the father, especially if the man claims him and no one else does. Their logic is that the Shariah values the welfare of the child and seeks to provide them with a stable identity. If the father acknowledges his act and takes responsibility, the child is given his name and legal lineage is established. This moves the child from being a social ghost to a recognized member of the family tree. Therefore, the link to inheritance becomes a logical necessity once the lineage is proven. In Islamic jurisprudence, the branch must follow the root. This is expressed in the maxim: النماء يتبع الاصل The growth follows the root. If the law accepts the father's claim and grants the child his surname, it has effectively recognized the root of the relationship. It would be a legal contradiction to accept the boy as a son for identity but reject him as a son for the estate. This is further reinforced by the principle: الخراج بالضمان The return belongs to the one who bears the liability. Since the father who acknowledges the child becomes liable for his maintenance and protection, the child becomes entitled to a share of his legacy. While the majority of scholars stay strict to protect the institution of marriage, this minority view offers a path of mercy for the innocent child. It ensures the boy is not left destitute or without a legacy because of the mistakes of his parents.

Wa Alaykum Asalam. The majority view in Fiqh is that a child born of Zina is attributed to the mother. The biological father has no legal link to the child in this situation. This is grounded in the Hadith: "The child belongs to the bed, and for the adulterer is the stone." Because there was no marriage contract, there is no legal "bed" for the father to claim. The child bears the mother’s surname and inherits from her side of the family alone. However, there is a minority but strong opinion held by scholars such as Ibn Taymiyyah and Ibn al-Qayyim. They argue that if the biological father wants to claim the child and the mother was not married to someone else at the time, the child can carry his name. They look at the "Maslahah," which is the welfare of the child. It is better for the child to have a father who is legally bound to them and takes responsibility than to wander through life with a gap in their identity. Regardless, the child is completely free of sin and is born on the "Fitrah" (natural state of purity). I have seen people ask about this many times. The law is firm here because it wants to protect the structure of the family. It tells men that they cannot have the rights and the honor of fatherhood without the commitment of a marriage contract. If you want a child to bear your name and legacy, you must enter through the front door. It is a serious rule, but it is there to make sure that the foundation of every home is built on a clear and legal promise. Allah knows best.
