Last year, Justice Jackson dissented in the U.S. v. Skremetti case-- in which she argued that states have no right to ban gender transitions on minors. Today, she was the lone dissent on Chiles v. Salazar, writing that "there is no right to practice medicine which is not subordinate to the power of states." So, states have no right to pass laws banning children from changing their sex-- but states DO have the right to ban counselors from telling boys they are not girls. You truly can't make it up.

Last November, @ADFLegal sued Chicago Public Schools on behalf of Moody Bible Institute—a well-known evangelical college founded in 1886. Despite an ongoing teacher shortage with hundreds of open positions, Chicago Public Schools barred Moody’s well-qualified student teachers from observing classes and taking internships in the city’s public schools. Why? As a Christian college, Moody has a longtime policy of hiring like-minded believers—and Chicago said that policy had to change. In other words, Chicago demanded that Moody give up its faith-based hiring practices to qualify for the student teaching program. After ADF filed a First Amendment lawsuit, the city reversed course. It has now modified the Student Teacher Internship Agreement, recognizing Moody’s right to hire staff in alignment with its faith. As a result, Moody will sign the agreement, and its students can participate in the program. This is the kind of story where everyone wins. Moody’s student teachers get internship opportunities, Chicago’s public-school students get more good teachers, and religious liberty is protected for everyone. We hope this will provide a lesson to school boards everywhere: it’s not their job to police a religious non-profit’s hiring practices. Respecting the Constitution is the far better path—for everyone.
