S.244 would allow non-parties to be added to verdict forms in civil cases in South Carolina, just like in California. The practical effect in litigation will be to limit what the injured party recovers by limiting what the at-fault party’s insurer pays, achieved by the defendant being able to allocate a % of fault to a phantom third-party neither sued nor present at trial to defend themself.

Don’t believe this. First, the reference to D-Day, where the Greatest Generation launched the heroic, largest amphibious invasion in military history, at extraordinary human loss. Offensive to refer to S.244 in the same breath as that remarkable moment of American, and world, history. Second, the reason cited for the “deal” collapsing. It wasn’t due to “pressure from trial lawyers,” it was due to certain Senators and their proxies playing dirty pool with their own colleagues! No real leadership, in-fighting, misrepresenting proposals from stakeholders, and certain legislators misleading other legislators as to the devastating practical effect certain sections will have on our civil justice system. This is why it was done behind closed doors and not on the Senate floor as they promised it would. Zero amendments from subcommittee, zero amendments from committee, and now zero substantive discussion or votes on amendments on the floor, after the 6 days they allotted for it have expired. Now it’s a time crunch because they have to work on the budget. Politics over people. The House Bill H.3497 sitting there being delayed instead of acted upon is further proof of that. The Senators standing up for citizens, and the process itself, should be admired and thanked for not caving to the extreme pressure that the insurance machine with unlimited funding and elected officials acting in bad faith are subjecting them to, just to cram S.244 down South Carolina’s throat.

Massey says Tuesday is “D-Day” for this bill. They will either have a deal or begin taking up amendments. No breaks. They said they thought they had a deal this morning but it collapsed — he says, due to outside pressure from trial lawyers.

H.3497 was UNANIMOUSLY passed (109-0) by the S.C. House, yet the Senate won’t take it up. Why? B/c Sen. Ross Turner objected to it. Wonder why why Sen. Turner prefers a bill (S.244) that gives so many gifts to the Insurance industry at the cost of everyday South Carolinians? 🤔

“The liquor liability bill [H.3497], a piece of legislation targeted at addressing skyrocketing insurance costs faced by bars and restaurants, was passed by the House Thursday in 109-0 vote. According to the South Carolina House Republican Caucus, the plan will deliver immediate relief to small businesses and ensure accountability and responsibility for those who serve alcohol. After a third reading this week, the measure will head to the Senate where that chamber hit a significant roadblock on a similar plan [S.244] that takes on tort reform in a much more wide-ranging bill that looks to address not only liquor liability lawsuits, but also medical malpractice, even contractor disputes, to name a few. Thursday's Senate session came to an abrupt and awkward end after senators refused to kill off an amendment that the bill’s lead sponsor, Senate GOP Leader Shane Massey, says would essentially blow up the bill. “We’re done. It’s over,” said Massey on the Senate floor before calling for the day's session to adjourn.

Everyone hates insurance companies. Plaintiff’s lawyers- They don’t pay what they should on claims; they delay and deny unreasonably… Defense lawyers- They pay low rates, flat fees; they cut time; they don’t listen to reason… Insurance companies are the worst.

Checking in on the “tort reform” / “insurance reform” / “lawsuit reform” debate in South Carolina… it would seem to defy LOGIC to accept any changes that will HURT the citizens of SC on the HOPE that S.C. businesses MAY see some UNKNOWN trickle-down relief in a few years. S.244

Here is how my 2024 is beginning. Minding my own business this morning working at my desk, I received two inflammatory text messages unsolicited from Will Folks. He obviously is trying to start a war with me because of my support of my Podcast partners Mandy Matney and Liz Farrell. In fact, last week, he texted me and asked me how I can continue to support. Mandy and Liz. I make no apologies for my support of Liz and Mandy. I think that there is just been too much back-and-forth hostilities about things that have nothing to do with Justice and the Murdaugh issues. I have participated in none of the back-and-forth on twitter or on line regarding some of the personal issues that have been on Twitter about Will Folks. It must be because there is a lull in the cases and Fits News is trying to fill the airways. I really question whether Will Folks wants to be a full-time objective Journalist or just a pot stirrer. I really like Dylan Nolan who works for Will. He is nice and professional but i guess he can only do so much. I don’t know what Will’s agenda is at this point in time. He just seems to be incredibly jealous of the success that Liz and Mandy have had. I respect the both of them, and what they have accomplished. It cannot be debated the impact that both of them have had on the uncovering of many of the key Murdaugh facts. Will is obviously jealous that Mandy’s success has been meteoric and Will Folks has been left inhaling her exhaust fumes. He threatened me about opinions that I have publicly expressed about former Chief Justice Jean Toal. My opinions about her have been consistent and have never changed. I believe that she is one of the, if not the smartest, appellate court justices our state has ever had, and certainly should be admired for being a pioneer for women. I sometimes don’t like her temperament and the way she sometimes speaks to Lawyers who appear before her, but those are my opinions and it is her courtroom. I have disagreed with the manner in which she has treated my partner Ronnie and me on a matter that came before her in the early 2000s. That is no secret as well. She reversed a lower court judge’s opinion where he stated that our conduct was commendable and in the spirit of good lawyers. Bottom line is I I asked Will Folks to stop texting and communicating with me. He is not worth it and in time Fits News will die in due course if he continues to put petty disputes in front of good objective journalism. I have said my peace. EB @MandyMatney @elizfarrell
