A reminder: there is no genocide in Gaza. The ICJ didn’t rule that there was a “plausible genocide” in Gaza: that’s a misinterpretation of the preliminary ruling. The bad faith, the disingenuous and the stupid have seized on a word they don’t understand in the ICJ context: plausible. The court has to decide whether there is a case to rule on. It simply means in this instance that there *might* an infringement of a right (ie not to be victims of genocide), *if* South Africa’s claims are proven. The courts stated twice that there was no ruling on findings of fact (paras 30 & 62). Here’s the direct quote from para 54, for the avoidance of doubt: “…the facts and circumstances mentioned above [ie S Africa’s evidence] are sufficient to conclude that at least some of the rights claimed by South Africa and for which it is seeking protection are plausible.” And they won’t be so proven. There isn’t a cat’s chance in hell of proving the dolus specialis needed for genocide on the evidence S Africa have submitted thus far. To remind you: “To constitute genocide, there must be a proven intent on the part of perpetrators to physically destroy a national, ethnical, racial or religious group. Cultural destruction does not suffice, nor does an intention to simply disperse a group… In addition, case law has associated intent with the existence of a State or organizational plan or policy…” (UN Office on Genocide Prevention) There’s no evidence in South Africa’s submission of an organisational plan or policy. A bunch of out-of-context quotes by lawmakers and decision-makers, that that have been clarified; bundled with quotes from those nowhere near policy (including a quote from an alleged member of the Knesset who doesn’t exist); do not prove an organisational plan or policy. Also consider other case law on genocide in Yugoslavia, which disregards the warfighting rhetoric that makes up so much of S Africa’s allegations of intent, and the case looks increasingly like exactly what it is: politically-motivated lawfare that runs the risk of gravely undermining international legal systems for future cases. What you are seeing in Gaza is simply what urban warfare looks like. Absolutely horrific it is; genocidal it is not.
