This tweet from Liquid Death is a prosecutor's wet dream. Liquid Death’s “10% of profits” defense is worse than the original problem. Let me explain: Their cans literally say “10% of the profits from every can sold is donated to help kill plastic pollution.” That’s a PER-SALE charitable claim. To the average consumer, that means: “When I buy a can, part of that money helps the environment.” Regulators would also interpret that as a per-transaction promise, not a company-level one. Now the founder is saying, “We weren’t profitable, so 10% of zero profit is zero donation.” Here’s the issue — that’s not how marketing law works. Under FTC and state consumer protection rules, a claim is judged by what a reasonable consumer believes, not by what the company meant or how it keeps its books. Consumers aren’t expected to know whether your business is in the red. If your packaging implies an active donation from every purchase, you need to actually make those donations—or clearly disclose that it only happens if you’re profitable. Otherwise, it’s deceptive advertising.

Hey Tim. Let's talk math. We talked at length about beverage business realities and how LD is still not yet a profitable company. And we definitely were not 4 years ago. So when the verbiage says "10% of profits" that could mean 10% of $0 which is $0. Which is not true. I simply forgot on the spot and heard you say "10% of sales" which you did say, which was never true. We have documented donations of hundreds of thousands of dollars per year even when we were small and unprofitable. That is why the copy was changed to be "portion of the proceeds is donated" to be more clear that we actually donate money. Where saying 10% of profits doesn't actually convey real donations if a company isn't profitable.

When I was at the .@Timcast studio, there were multiple refrigerators filled with aluminum cans, and probably hundreds more stocked piled in the building. So after watching him try to cancel .@LiquidDeath for following the same regulations as every other company he promotes, I think it’s fair to demand he throw every fucking one of them in the dumpster. If you see an aluminum can on the table during his show moving forward, that’s all the evidence you need he doesn’t actually care about what he’s claiming. He’s just trying to destroy a business because he doesn’t like the owner. Fuck cancel culture!

No what you are reading on our site is correct. Our Mountain Water products (plain still and plain sparkling water) uses water from natural mountain source. Tim's blanket tweet "Liquid Death's water comes from LA municipal water" which is easily interpreted as ALL Liquid Death products use RO tap water, is false. Tim is only referencing our flavored products across soda, iced tea, and energy use RO water. But he doesn't make that clear.
