Time to Hold the Enablers Accountable
When an illegal immigrant or an H-1B visa holder gets behind the wheel drunk, wrecks a family, or commits a violent assault, we rightly demand justice for the victim. But what about the suit in the corner office who signed the papers, looked the other way on paperwork, or chased rock-bottom wages knowing the risks? That’s not just bad business. It’s playing with other people’s lives for profit.
Think about the accessory principle that’s been bedrock in our legal tradition. Drive the getaway car for a bank robber? You’re on the hook too. Hand someone the keys and cash under the table, or sponsor them into the country while skipping real vetting for the sake of cheap labor, and suddenly we’re supposed to pretend there’s no connection when the worst happens? That doesn’t track with common sense or basic fairness.
Morally, this setup betrays the social contract. America isn’t a buffet where corporations pick foreign workers for flexibility and lower costs while taxpayers eat the externalities—emergency room visits, police calls, lost wages for American workers pushed out, and shattered families. The sponsor or employer profits from the presence; they shouldn’t get to wash their hands when that presence turns destructive. It treats rule of law as optional for the powerful and mandatory for everyone else.
Psychologically, it’s classic short-term greed. Executives chase quarterly numbers and labor “solutions” that displace citizens and suppress wages. They convince themselves “no one else will do the work” while ignoring how enforcement would force innovation, better pay, and legal hiring. H-1B sponsors tie workers to them, creating dependency that can hide problems; under-the-table ops thrive on plausible deniability. Both reveal a mindset that prioritizes margins over the moral weight of importing risk to communities.
Legally, we already punish knowing hires of unauthorized workers with fines and, for patterns, jail time—though enforcement stays weak. We can do better: treat sponsors and CEOs as having a duty of care. If they enable entry or employment, hold them civilly or criminally liable for foreseeable harms, like dram shop laws for bars serving drunks. No more shielding the root cause while the street-level guy takes the fall.
This isn’t cruelty to immigrants. It’s self-preservation for a nation. Corporations that treat sovereignty like a suggestion need skin in the game. Enforce the law rigorously, end the cheap labor loophole, and watch wages rise and communities stabilize. Americans first means making the enablers pay their share
