Why the 1 February 2021 Military Coup in Myanmar was Unlawful under the Constitution In order to seize power, the Commander-in-Chief Min Aung Hlaing needed the National Defence and Security Council (NDSC) to declare a State of Emergency so that power could lawfully be transferred to the military. But President Win Myint as Chairman of the NDSC refused to call a meeting of the NDSC, on which military members could outvote civilian members by 6 to 5. He was then faced with an ultimatum, to resign on grounds of alleged ill-health, or be arrested and face charges. These included “incitement” or sedition. Win Myint declined to resign. He should however have been protected by Article 71 of the Constitution which sets out the detailed process for impeaching a President or Vice-President. This process was ignored by the military because they knew it would take weeks of parliamentary time to complete the impeachment process, the final decision requiring a two-thirds majority for impeachment which the military could not hope to achieve as the National League for Democracy held over two-thirds of the seats in both the Lower and Upper Houses. As the junta regime faces increasing defeats in Hpakant, it resorts to air strikes in the Lungkhin ward of Hpakant town. @ASEAN @zawmoethant71 Together ASEAN countries failed on people of Myanmar . The military has been bombing civilians with air strikes since 2021 coup and ASEAN still sticks to 5 point consensus which Myanmar military never observe from the outset in April 2021.
