@Reachingou59420 @NicoPerrino @BedoyaUSA Does this same standard also apply to a good book series that one cannot put down? It could be construed as addictive and harmful to productivity. Trying to throw this kind of liability at speech is a very slippery slope.

@NicoPerrino @BedoyaUSA you're trying to reconstrue the argument here. Companies were found liable for creating an addictive harmful algorithm and when those companies studied their own algorithms and effects they doubled down.

"Where are the parents?" The parents are working two or three jobs to pay for their kids food, clothes, and doctors appointments. The parents are trying to make dinner while also arranging for childcare because *their* mom or dad is sick and needs to be taken to the doctor. Thirty years ago you'd turn on the TV and it would be fine. Now, you turn on a Lego video on YouTube and by the time you come back a half hour later it's showing your kid weird ASMR unboxing videos or even weirder cosmetics demos on an 11 year-old girl. "The parents" are not responsible for a billionaire tech company's decision to exploit children's attention for their financial gain. And the idea that the First Amendment written by James Madison was intended to immunize Google and Meta for this conduct is, respectfully, laughable.

Without having read the briefing, it's not at all clear to me how a claim premised on "They presented information to me in a way that made me want to consume much more information" can be squared with the First Amendment.

@hungus14 @ZephyrTeachout @TaylorLorenz All speech has the potential to harm. The first amendment exists for that very reason because harm is such a loaded term that it can and will be used by anyone with power to silence dissent and critique.

@ZephyrTeachout @TaylorLorenz Taylor is too young to know about the bad faith hysteria that fueled “tort reform” in the 90s. John Grisham wrote a semi fictional book about it. Does the product harm? Fix the f’cking product.

They are designing horrifically dangerous products and calling it speech and we are done.

@mizzkararose @NicoPerrino @TaylorLorenz @shipitkthx This isnt really how section 230 works. The law does not place restrictions on editorial choices because those are be protected by the first amendment. 230 is intended to protect being a publisher of third party speech.

I'm concerned about this verdict and the overall trend of treating speech platforms as addictive — and therefore dangerous — products. Also, the verdict diminishes the responsibility parents have to raise healthy kids. For example: "Kaley says she began using YouTube at age 6 and Instagram at age 9 and told the jury she was on social media 'all day long' as a child." Where were the parents?
