To exclude NHS acute providers from merger control, would need to move to a spillover market (like NHS mental health) where private providers can only be chosen if no capacity at local NHS acute trust. Whether this is in best interests of patients is another matter (2/2). twitter.com/Taylorandrew45…

@astainer77 @sib313 Tricky one in A&E/acute med. can’t easily assess baseline pre intervention as in planned surgery - not least because often inappropriate or unable to do so when Pt acutely ill/ often no long term follow up required. Has even been difficult to extend in surgical conditions

@rogerkline Agree. The severity of the outcome of the error should not be the main factor when deciding the sanction. The same errors could have led to a less tragic outcome. But the risk to future patients is the same
