Dear Friends, There appears to be confusion about an article in the Australian concerning Hash Tayeh’s criminal proceedings. That criminal matter has no bearing on the successful outcome of the separate civil proceedings in Vorchheimer v Tayeh [2026] VCAT 134. In the civil case, Judge Tran found that Mr Tayeh, by initiating the chant “All Zionists are terrorists” at a rally on 23 March 2025, contravened sections 7 and 8 of the Racial and Religious Tolerance Act 2001 (Vic). The criminal proceedings are brought under different laws and involve a completely different legal question. Victoria Police do not need to prove the chant was antisemitic. The issue for the criminal court is whether the words / conduct was “grossly offensive”. Absolutely sickening! At an UNDER 12’s netball game in Sydney, a mother was overheard saying “F--- the Jews” and “they should have all been eradicated”, against kids from a Jewish team. The slur was made in front of a mother who gave evidence to the royal commission this week.
