The IRS drove Alex Council to his death over a tax bill they later admitted he never owed.
Alex and Kay Council ran a business together in North Carolina.
The IRS audited them and hit them with a tax bill of over **$300,000** money the agency claimed they owed.
Alex knew the assessment was wrong. But fighting the IRS costs money most people don't have. The bill hung over the family. The pressure was relentless and crushing.
On the day before he died, Alex left his wife Kay a note.
It read: *"My dear Kay, I have taken my life to provide capital for you. The IRS and its liens which have been taken against our property illegally by a runaway agency of our government have destroyed everything. I love you and the children. Kay, don't let them get away with it. Make them pay."*
He took his own life so that his **life insurance payout** could fund the legal fight he couldn't afford while alive.
Kay honored his last wish. She used the insurance money to hire lawyers and fight the IRS in court.
**She won.**
A court found that the Councils never owed the money. The $300,000+ bill that destroyed her husband was wrong all along.
The IRS had driven a man to his grave over a debt that didn't exist.
Kay's testimony and the story of that suicide note helped spur the IRS Restructuring and Reform Act of 1998, which shifted the burden of proof onto the IRS in certain disputes.
It took a man's death to force the agency to prove you owe something before they take everything.
Alex Council was right. He just didn't live to hear a court say it.
