Unfortunately for his grand constitutional intervention, Section 3 deals with attempts to overthrow the Crown or helping a foreign power invade British territory. Illegal migrants are not, in law, a “foreign power”. No court has ever interpreted the Act that way, and if this argument had even a flicker of legal merit, he’d be able to point to a single prosecution or judgment supporting it, but he didn’t. Quoting a Victorian statute isn’t the same as understanding it.
