A registered sale deed isn’t always non-arbitrable- if it’s part of a private business arrangement with no third-party rights, arbitration can decide. Context matters for ascertaining arbitrability. I have been quoted commenting on this aspect on @moneycontrolcom

The challenge, then, is not whether to disclose, but how much to disclose and under what safeguards. Drawing on recent reforms, I argue for a middle ground: selective but meaningful disclosure. The goal should be to protect arbitral integrity without eroding confidentiality.

I argue that mandatory disclosure of TPF is often justified on grounds of legitimacy and conflict checks. But full exposure of funding agreements risks undermining commercially sensitive information, procedural fairness, and even investor confidence in ISDS.

ISDS has always walked a tightrope between confidentiality and transparency. The rise of TPF has made that balance even harder to strike. My recent paper, published in the @JournalOfIDS examines how far disclosure obligations should go. @icsid @BurfordCapital @ICC_arbitration

@BJVerbeek This is interesting. How do disclosure obligations in such cases work? As per normal disclosure obligations, the arbitrator is obliged to disclose potential conflict of interests. There are none here. And it's surprising that Italy did not know about this before.
