🚨MUSK DROPS FRAUD CLAIMS AGAINST ALTMAN - TRIAL SHIFTS FROM JURY TO JUDGE Elon Musk's lawsuit against Altman and OpenAI had four claims going to trial: 1. Breach of charitable trust 2. Unjust enrichment 3. Promissory fraud 4. Constructive fraud On Friday, Elon Musk's lawyers asked Judge Yvonne Gonzalez Rogers to dismiss promissory fraud and constructive fraud claims. She approved the same day. What's left is breach of charitable trust and unjust enrichment. Most news coverage has read this as a retreat. It is closer to the opposite: >Fraud is a Jury question >Charitable trust is a Judge question What this means is the Judge decides this case alone. Not the Jury. Their role now is advisory only, meaning their verdict is non-binding. This is the same judge who already cited Brockman's 2017 diary — "it was a lie" — in her own ruling denying OpenAI's summary judgment. Elon Musk's case just got stronger. He moved it from a jury he can't predict to a judge who already showed her hand. That is a different trial than the one being covered in mainstream headlines. This trial is now about whether a federal judge will use charitable-trust authority and donor-standing precedent to get Sam Altman removed as CEO and unwind the nonprofit-to-for-profit conversion that California Attorney General approved six months ago.

🚨MUSK DROPS FRAUD CLAIMS AGAINST ALTMAN - TRIAL SHIFTS FROM JURY TO JUDGE 1. Fraud - is “conning”. Yes, you can sue someone for misleading or misrepresenting themselves or a product. Ilya, Greg, Sam consistently did this. Shivon misrepresented Elon’s goals to Open Ai and did not support his mission when given another direction by them. 2. None of the documents point to him wanting to change it into a “for profit” entity. He did for ask clarification when Sam offered a new type of cap he had not heard of before. Elon is repetitively stating he wants it to remain a “non-profit” in practically every email and text. 3. Merging with Tesla is not what he claimed. Sam Altman and Ilya were discussing this option. In one email in 2017, Elon toys with the suggestion because although he has given them 35 million in 2016/17, they are low on cash funds according to them. Elon dismisses the idea. Shivon also reminded them Elon’s goal is centered on Mars. (within the first 5 years of the startup Elon will give them $44 million in cash as well as funding their personal research, cars, paying for the rent & services, as well as other perks). 4. He is funding nearly all of the support for Open AI in 2017. They tell him they have other investors but in reality he is the exceedingly larger investor than any other. He has every right to be informed and allowed to make decisions on his proportionate investment in Open AI. This isn’t about “illegal” control so much as ethically managing ‘designated funds’. 5. There are no claims or reason to ever suggest impeachment for Elon at any point in this case. He continually wanted a “non-profit” and didn’t change course on this either at any point. 6. Shivon stayed working for Open AI as a consultant and later as a board member despite any ‘conflict of interest’ that Open AI could have asked her to leave. However, as proof in the emails and tests, she was actually feeding Open Ai information and supporting their “for-profit” cause. She was no help to Elon. He also stated in this email that you are referencing, she is the one who offered to be a mole which his response was that she could do whatever she wanted. The initiative and the source for deception is her by her own admission. 7. Many times she is supporting whatever Ilya and Greg suggests according to his dairies. The “sensitive” information is coming through Shivon as a “conduit” TO Open AI - not from them. (Also keep in mind, during this time Neuralink and Open AI are in the same building - who knows how many other private conversations of betrayal were happening). 8. The judge told him that he could only bring 2 charges - not 4 - to fit the court timeline. Dropping charges is not by choice. I think Elon could probably care-less what is brought up in the trial. Their fraud is obvious but the center-point of the whole argument is did ‘Open AI change to For-Proft and make money from it?’ This is the only question the jury has to answer - it’s a resounding YES!! (Just a couple of years later after being a professor and finishing his doctorate, Ilya has enough “extra” money to invest $4 billion in a startup. Every person with Open AI gained so much money from the “for profit” side that every single one of them started their own companies ….) 9. Elon was not the one in charge of managing funds - that was Sam Altman. Greg Brockman and Ilya are writing to Elon on a rather consistent basis for more money which Elon gives them based on trust. He doesn’t interfere and I think this is really how the fraud catapults in so many different areas. It is Elon’s very LACK of control that these people use his money for fraud and their own personal interests. 10. I hope they do use Shivon’s emails. It convicts her of her own manipulation of Elon and her betrayal and fraud towards him. Sam directly asks her how to manipulate Elon to get the response that Sam wants. Seriously …. Shivon has never been a friend to Elon.
