JUST IN: A High Court case has been filed that could affect how millions of Kenyan Muslims receive official announcements for Ramadan and Eid.
According to The Standard, Abdirizak Issack Sheikh has sued Kenya's Acting Chief Kadhi, the Attorney General, the Judicial Service Commission (JSC), and the Interior Cabinet Secretary.
His argument is that the Chief Kadhi, as a judicial and government officer, should not be the one officially announcing the start and end of Ramadan, Eid al-Fitr, and Eid al-Adha. He argues that this responsibility belongs to religious leaders and scholars, not a state judicial figure.
The case touches on some of the most sensitive and long-running debates in Islam.
Some Muslims believe the moon must be physically sighted before Ramadan or Eid can be declared. If they do not see it, they complete the month and begin later.
Others believe the first credible sighting anywhere in the world should be followed, which is why many often follow Saudi Arabia's announcements.
There is also disagreement over whether telescopes and modern astronomical methods should be used, with strong views on both sides.
For many Muslims, these are not small technical disagreements. They are matters of faith, tradition, authority, and religious practice.
One thing I can't help wondering:
If different imams and Muslim organizations are already free to make their own announcements when they disagree with the Chief Kadhi, what exactly changes if the courts rule in the petitioner's favour?
This could become one of the most closely watched religious cases in Kenya.
