ولی کی اجازت کے بغیر نکاح باطل ہے:
حضرت عائشہ صدیقہ رضی اللہ عنہا سے روایت ہے کہ نبی کریم ﷺ نے فرمایا: ”جس عورت نے بھی اپنے ولی کی اجازت کے بغیر نکاح کیا، تو اس کا نکاح باطل ہے، اس کا نکاح باطل ہے، اس کا نکاح باطل ہے۔“ (یہ حدیث جامع ترمذی، سنن ابی داؤد اور سنن ابنِ ماجہ میں موجود ہے)۔
ولی کے بغیر نکاح نہیں:
حضرت ابو موسیٰ اشعری رضی اللہ عنہ سے روایت ہے کہ رسول اللہ ﷺ نے فرمایا: ”ولی کے بغیر نکاح نہیں ہوتا۔“ (جامع ترمذی)۔
گواہوں کی شرط:
حضرت ابنِ عباس رضی اللہ عنہما سے مروی ہے کہ نبی کریم ﷺ نے فرمایا: ”ولی کے بغیر اور دو عادل گواہوں کے بغیر نکاح نہیں ہوتا۔“ (صحیح ابن حبان)۔
