A groundbreaking bill in New Zealand aims to grant legal personhood to whales. If passed, the Tohorā Oranga Bill would transform whales from protected wildlife into legal entities with enforceable rights, allowing them to be represented in court to defend their habitats and well-being. Introduced by Green Party MP Teanau Tuiono and strongly supported by Māori and Pacific leaders, the legislation is deeply rooted in tikanga Māori, which regards whales (tohorā) as sacred ancestors rather than mere animals. The bill would recognize whales as legal persons with inherent rights to free migration, natural behavior, and a healthy environment. This landmark proposal builds on New Zealand’s pioneering legal precedents, such as granting personhood to the Whanganui River and Mount Taranaki, complete with appointed human guardians. By extending similar rights to whales, the bill would enable legal action to be taken on their behalf whenever their habitats or migration routes are threatened. The legislation represents a profound shift in conservation law — moving away from traditional resource management toward a model where nature itself has enforceable rights and a voice in court.
