Here is the scenario you made in your segment, just with what the commissioner actually said... - a transgender woman (TW) applies for a job. Gets a job interview. - the TW has not disclosed that they are A TW, and presents to the world in public life as a woman. - at the interview, the interviewer meets the TW, and as the TW presents as female and the employer believes them to be a 'biological woman' (BW) - during the interview the interviewer asks about intention to have a family, with the assumption the TW is able to get pregnant as they believe them to be a BW. - if they are discriminated against as a woman for potential to become pregnant ie potential pregnancy (the same as if this were to happen to a BW in the same scenario of a belief of the employer that they are engaging with a BW), then this is discrimination due to this potential act.
