Well, I certainly did not see that in the body cam video, but there was a point when the cop was pulling up that you couldn’t really tell at first where he was at. I’m glad it worked out for the kid because the dude was just trying to make a living. Have to say I’m very surprised anything came over it.

Once again, it's not about surrendering your rights; it's about whether the cop legally had probable cause or not. I'd imagine if he tells a judge that he saw someone hiding in front of a closed business, the judge is gonna agree that he had probable cause. That's my statement. I it’s not about how we feel about it. It’s about what’s gonna happen in the law and that’s my point.

Well, he’s gonna argue nevertheless that he saw this man hiding in front of a closed building behind a pillar, as he said as much on the video. And I’m gonna say here—and I’m thinking probably in court with the judge as well—that it’s gonna make the same determination that I do. The prosecutor is going to be granted probable cause. It’s not about how we feel about it. It’s just simply what’s gonna happen in the law. Could a liberal judge find no probable cause to detain him in the first place? Maybe, I doubt it—not with the cops sitting on the stand telling the judge what he saw. You don’t have to be about to kill someone; you can be about to jaywalk.

@NotMoriarty1 @johnbryanesq Under Florida law, law enforcement officers can stop and detain you if they have reasonable suspicion that you have committed, are committing, or are about to commit a crime. Which the officer did not have. Hence why he was fired.

Yeah, the cop was a total asshole, but it doesn’t change the legal facts. The problem with most of you guys and many I meet in my life is you think the law should be this way or that. It’s all about feelings, but unfortunately it’s not. The cop undoubtedly had the right to ID him. Chances are if he would’ve just given up his ID he would’ve been on his way.
