However, regrettably these reports have surpassed referrals, up to 60% of monthly probation court. Where to with this? I'm was behind the introduction of this practice in kenya but im not happy coz prison remand continue to rise. @Kenyajudiciary @ProbationKE @PrisonsKe @ODPP_KE

Dear Kenyans, please don’t go to fight in Russia or Ukraine. I say this with a very heavy heart. While I was silent and away, I spoke to people who are in Russia now and in Ukraine. I even saw videos. What I’ve seen and heard is heartbreaking. Kenyans are being lured with promises of jobs and good pay, but once you land, the story changes. You’re received warmly, driven around in luxury cars, and told everything is okay. Then, after a few days, they say your visa has expired. With no money to go back home, they offer you a “military job.” If you reject you are told to refund the money that was used on you, which mostly is over 1 million ksh . The papers you sign are in Russian, and detailed that you are forced to sign, and from that moment, your life is no longer yours. You get barely two days of training, a rifle, and are sent straight to the frontline. Yes 2 days , and you now have to fight professional Ukrainian or russian forces. Worse africans are being used for the most dangerous missions. They throw you infront in their offensives knowing you will be killed the most . Many are killed. Those injured are often left to die, phones and passports are taken away, so no one ever finds them. From what I’ve gathered, over 50 Kenyans are already dead. Please, my brothers and sisters, there are no jobs in Russia. Only danger and deception. Don’t fall for it. If you know someone planning to go, warn them. Share this message. Save a life. #StayAwakeKenya 🇰🇪

What do sentencers punish, The crime/offence or the person? If it were the latter, prisons would not be as congested. Must every offence be punished? Why do we have provisions for alternative sentencing? Does incapacitation 'treat' crime? We need to rethink sentencing.

Constitution of kenya guarantees all accused persons right to bail. This clause helps check presumptive detention even when there no potential risks. Our remand homes are congested with persons granted cash bail but cannot afford. Why are we punishing poverty. @Kenyajudiciary

@CorrectionalKE I don't think there is any plausible legal framework. Police clearance certificate should only be issued on request by a potential emoloyer & the fees thereof be paid by the potential employer. The process of issuance of the documentdisenables many from accessing opportunities

State Department for Correctional Services | Kenya
A committee tasked with looking into the possibility of issuing police clearance certificates to rehabilitated ex-offenders is currently reviewing global good practices, current legal frameworks and challenges as efforts to help reformed inmates acquire nil certificates of good conduct gathers pace. Speaking during a meeting with members of the committee on police clearance certificates for rehabilitated ex-offenders, Correctional Services Principal Secretary Dr. Salome Beacco said the current framework of issuing police clearance certificates lacks provisions for facilitating the rehabilitation of ex-offenders. The committee is expected to among others develop a comprehensive legal framework for record sealing, review existing legislations and guide on institutionalization of aftercare programs. While Kenya’s current legal framework provides for the collection of forensic evidence and the issuance of police clearance certificates, it does not sufficiently address the rehabilitation and reintegration of offenders particularly with regards to the record sealing of criminal records. The limitation prevents ex-offenders from obtaining police clearance certificates that are free from past criminal records.

I've noted very encouraging sentencing policy review in England and Wales based on the follwing new principles. 1.making sure prison sentences punish serious offenders & protect the public 2. ensuring there is space in prison for the most dangerous offenders

@Kenyajudiciary, there are many courts that order for bail reports or presentence reports but wouldn't use or make reference to them. Do they know how much it takes/costs to generate such reports? Can that be termed an abuse of court process? @ProbationKE @NCAJ_KE

Unfortunately, many young people will fall culprits to the justice system during this festive season due to associated merry making. If only some proactive and preventive measures could be taken by their families and responsible institutions, many would not fall 'victim'.

@jimbrownblog It should never be a joyous moment for a PO to recall a client. It shouldn't be a kneejack action. As originally thought, pobation law should was never be a rigid framework. The PO always should rise above and see the bigger picture in the work. Otherwise it will be zero sum.
