@FresenGary @PeterSchiff Ridiculous. Income taxes are excises and not direct taxes on property, per SCOTUS. Excises are only applicable to taxable activities. Sec 1 imposes a tax on anyone earning TAXABLE income IF they engage in a revenue taxable activity. Is your job specifically taxed? Not likely.

26 U.S.C. § 1 itself imposes the tax and thereby creates liability. A separate provision is not needed. The tax is imposed directly on the taxable income of the persons identified. Happy April 15th, belatedly, and I hope that you paid your taxes. Courts consider your legal argument as frivolous.

26 U.S.C. § 5001 imposes a tax on alcohol. 26 U.S.C. § 5005 creates the liability to pay the alcohol tax. 26 U.S.C. § 5701 imposes a tobacco tax. 26 U.S.C. § 5703 creates the liability to pay the tobacco tax. 26 U.S.C. § 4401 imposes a tax on wagering. Section 4401(c) creates a liability to pay the wagering tax. 26 U.S.C. § 1 imposes an income tax. However, there is no section that creates a liability to pay the income tax. That is not an accident. It's because the payment of the income tax is legally voluntary. The payment of those other taxes is mandatory. If anyone can find a section of the IRC that specifically creates a liability to pay the income tax, in the same way that the IRC establishes a liability to pay the alcohol, tobacco, or wagering taxes, please reply to this post with the citation.

@PeterSchiff The 16th Amd clarified that tax on income is an excise. All those taxes you cite are in essence income taxes on taxable activities. 26 USC 1 imposes a tax on TAXABLE income. But unless you engage in a taxable event, then you have no TAXABLE income.

@laralogan There are many sections in the IRC that make one liable for the excise tax known as "income tax". But there are no sections laying a tax on the majority of common private sector occupations. Unless it's specifically taxed by congress, no tax is owed. Is your occupation taxed?
