There’s this need I’ve seen from women (feminists) to prove that they are not biased, the urge to be ‘fair’ to show that their morals are right, that as they are calling out women, they are also calling out men. I am here to say that’s nonsense and you should kill it today.

@dafabulousinc_ @InibeheEffiong This is incorrect. A lawyer cannot dismiss an expert testimony in a field he is not qualified to speak on. It can only be done by the counter arguments of another professional which is lacking in this particular scenario.

@Peridotkween @InibeheEffiong Even expert testimonies are not taken hook line and sinker because he is an expert but because there are researches to backup the claim. Researches a lawyer can also be privy to and can also use to disprove the experts claim/counter it.

I am following the discussion online about cross examination by lawyers in the light of Davido’s recent unpleasant experience in court during a custody hearing.
I will share just two past experiences.
Be patient.
A couple of years ago, I cross examined a medical doctor who came to court to give evidence in a divorce petition in support of the Respondent (the woman).
We were for the Petitioner (the man).
Our client’s petition was grounded on adultery.
In the petition, we joined the woman’s Pastor and her Policeman friend as Co-Respondents (a co-respondent is the person with whom the respondent committed adultery).
My client had records of very explicit and salacious conversations between his then wife and the two co-respondents. The evidence was compelling.
The idea that women are better at hiding their tracks when they cheat only works when a man doesn’t know how to catch and expose a cheating partner.
I digress.
In her cross petition, the Respondent accused my client of being “controlling”, “insecure”, and “physically abusive”.
She further alleged that she lost her “pregnancy” due to domestic violence.
My client vehemently denied these claims and insisted that his then wife was never pregnant.
To prove her case, the woman called a medical doctor as a witness to speak to her bogus claims of pregnancy and miscarriage.
Looking at the medical report, I found the report manifestly unreliable and waited patiently for cross examination.
The first red flag was that the doctor in her report stated the age/duration of the pregnancy without conducting a scan.
The woman didn’t have evidence that a laboratory test was done to confirm the pregnancy either.
But the doctor, who claimed she treated her after the purported miscarriage, had the audacity to issue a questionable report stating the duration of the pregnancy and still came to court to testify for the woman.
What transpired in court after the cross examination amused me.
The doctor, who claimed to be an admirer of my work, was openly and loudly hostile towards me when the proceedings ended. She yelled and accused me of disgracing her and being mean to her.
I had to walk away.
Before then, I had another experience with a senior police officer who was the Acting Commissioner of Police in Akwa Ibom at the time. This man arrested protesters and charged them with attempted suicide just because they protested in front of the Government House in Uyo.
When my colleague met with him in the hope of resolving the case out of court, the officer insisted that he will only do so on the condition that I must apologize to him and publish the apology in a Newspaper for publicly condemning his actions against the protesters.
This senior policeman boasted that if I fail to apologize, he will personally attend the trial in his full police uniform and testify as a witness. In his words, “let me see the court that will not convict them”.
True to his words, the policeman came to the court in his regalia as the Acting Commissioner of Police and gave evidence against the protesters. He was so full of himself during his Evidence-in-Chief.
Under cross examination, I started by asking him when he joined the police.
I then intentionally asked him questions that embarrassed him.
The summary is that the policeman hurriedly exited the court premises under heavy rain and couldn’t wait for his orderly who had stepped out of bring umbrella. Seeing him soaked in rain while ‘fleeing’ the court excited my protesting clients.
Cross examination has a way of humbling even the most intelligent and mendacious people. You may think you’re the best liar in the universe until you are subjected to the fire of cross-examination.

@dafabulousinc_ @InibeheEffiong Médical diagnosis do not need investigations to be made. A thorough clinical history and physical examination can be used to make a diagnosis. Medicine is not a transaction where the variables are fixed. Your analogy is flawed.

@Peridotkween @InibeheEffiong Listen to what you are saying madam even as a med practitioner do you make a certain diagnosis without a diagnostic test to back it up? There was obviously nothing to back up the claim of pregnancy. You want law to believe a claim because you are a professional? Just like.....

@InibeheEffiong I disagree. Her evidence is the word of the professional she has asked to testify. The onus is now on you to substantiate your claim that she is lying which from the points you raised, you do not have. I fear you are the one making bogus claims in this instance.

He who alleges must prove. That is how it works. You cannot stand in a witness box and narrate a tale without evidence. It is not a matter for expert evidence. She came to court as the doctor who allegedly treated a patient. She could not provide evidence of pregnancy or evidence of gestation. Why should I pay attention to whatever nonsense she had to say?

@InibeheEffiong I was showing the loopholes in your assertion. Nothing you said is medically correct so I wanted to know how you came to the conclusion she was lying. As a doctor myself, I have dated pregnancies without scans and also know that a large portion of our patients do not test in labs

@InibeheEffiong I’m not saying that, but your hypothesis that the doctor is lying is also empty because you have not provided any evidence to say that she is. The way to say an expert witness is incorrect is by bringing another in the field to counter,which you have not done.

Saw a clip from Abott elementary and this is unfair to Christian Children.
We want Khadijah to feel included so we change the theme, what happens to Daniel, Elizabeth and Deborah who have been looking forward to Christmas presentation from January.
If Christmas is haram to Muslims then why don’t we encourage Muslim kids to avoid the celebration completely, not find a way to be involved.
