@BritisherPaz49 Jesus fuck, Starmer the wank jails people for online comments which means declaring someone guilty of a crime on here is defamation & spreading it on here is fucked up especially without proof. A blue tick as well which means you're trackable.

@JamesMelville Hindered? There's a right to not comment if the questions are ones you don't want to answer. Even if you're under caution. Do you want to erode those rights James? Do you want to compel people to talk? What lengths would you be happy with to do so? Waterboarding? Electrocution?

@TwisterFilm No fan of her personally but stating someone is guilty as fact is slightly dangerous legally, you should delete this.

@MichaeldeMonte2 @ChrisMusson In Scotland there is no adverse inference it doesn't exist under Scots law, the presumption of innocence is absolute in that department up here.

@PictishOne @ChrisMusson We are entitled to draw our own conclusions from her silence. In an (English & Welsh) Court, this is made clear to a jury, not sure about Scotland

@MichaeldeMonte2 @ChrisMusson The problem is stating it as fact, you can say you think she's involved but if you say she was definitely absolutely involved then you invite a defamation gig. I certainly don't have evidence to say she is guilty do you?.

Stating assumptions as facts on here is never a good idea. There is a massive difference between saying "I think" and declaring someone is guilty. The case is closed with no charges, end of story. By law, she gave her details and remained silent, which means she cooperated by law the end.

@DizzyLizzy2906 @Tamthebam2000 @ChrisMusson Jesus Christ, the SNP’s education system is clearly lacking. She DID cooperate. Cooperation means giving her name, DOB, and address when arrested, which she did. Staying silent after that is a legal right. It is not a contradiction. You can do both.

@PictishOne @Tamthebam2000 @ChrisMusson Well thats your interpretation of "fully cooperating." My interpretation varies from yours, especially the word "fully". Those were her words. Will leave it at that.

@gorbalsgoebbels @dobleplusungood @ChrisMusson She DID cooperate. By law, cooperation means giving the police your name, date of birth, and address when arrested. She did exactly that. Staying silent after that is a legal right, not "non-cooperation." You can do both.

@Only_Me_4 @ChrisMusson Not under Scottish law, there is absolutely zero adverse inference under Scots law unlike English and Welsh law.

@Spa_town @ChrisMusson She absolutely cooperated. Giving her identification details upon arrest is complying with the law. Choosing to exercise her right to remain silent after that doesn't change the fact that she cooperated with the police process.

@PictishOne @ChrisMusson I’ve no quibble with there being a right not to incriminate yourself, but it doesn’t sit well with me that she publicly stated she was cooperating with police, if that was a flat-out lie.

@DizzyLizzy2906 @Tamthebam2000 @ChrisMusson Providing identification details upon arrest is active cooperation with the police, and exercising the right to silence does not erase that fact. She followed the law completely.

@PictishOne @Tamthebam2000 @ChrisMusson She didnt need to say anything whatsoever. But lies just tend to roll off her tongue with absolute ease to make herself look good. That statement from her saying she was cooperating fully, was a complete distortion, if these allegation are true.

Under Scots law, it’s entirely true to say you "cooperated but stayed silent." By law (S13, Criminal Justice Act 2016), a suspect must cooperate by giving their name, DOB, and address. Complying with that, while using your legal right to give a "no comment" interview, is the exact legal truth. She was a solicitor and she knows this.

@PictishOne @Tamthebam2000 @ChrisMusson Listen I have no issue with anyone sticking to no comment. And Yes this is sound advice from legal in my view. However, where it doesn't sit right is her constantly spouting she was cooperating fully with Police Scotland. If true she stuck to no comment then thats a downright lie

@DizzyLizzy2906 @Tamthebam2000 @ChrisMusson It depends on the context which isn't explained here. Was her silence due to legal advice? Most times a solicitor advises silence it's not something done on a whim but it's protected. A person does not need to prove innocence it's for the prosecution to prove guilt.

@PictishOne @Tamthebam2000 @ChrisMusson Then this allegation is saying she utilised her right to remain silent throughout. Yet she constantly stated on TV that she was fully coperating with Police Scotland. One contradicts the other. Thats dodgy. Its nothing to do with ppls right against self-incriminating 🤷‍♀️

Aamer Anwar has sent Scottish media a very threatening-sounding letter today warning them that if they don’t moderate any comments making defamatory allegations about Nicola Sturgeon, he’s been instructed to “consider” legal action and/or complaints to IPSO. Ooh, scary.
