The United States is not a state party to the Rome Statute, which founded the International Criminal Court (ICC) in 2002. The sole reason the Trump regime is going after the ICC is to try and protect Netanyahu. The ICC has issued an arrest warrant for Netanyahu, allegeding that he is responsible for the war crimes of starvation as a method of warfare and of intentionally directing an attack against the civilian population; and the crimes against humanity of murder, persecution, and other inhumane acts from at least 8 October 2023 until at least 20 May 2024. American citizens have nothing to fear from the ICC...

The radical outlier here is not Mamdani, but rather Trump and his DoJ. The US is legally obliged under the Genocide Convention and under the Geneva Conventions (IHL) to arrest and prosecute (or handover for prosecution) genocidaires and war criminals like Netanyahu found on US territory, and US legislation allows it to do so, including the Genocide Convention Implementation Act (18 USC Sec. 1091), the Genocide Accountability Act that supplements it, the War Crimes Act (18 USC Sec. 2441) and the Justice for Victims of War Crimes Act that supplements it. International law provides no head of state immunity for crimes like genocide. Neither US non-ratification of the Rome (ICC) Statute nor US legislation prohibiting cooperation with the ICC are a bar to such (obligatory) action by the US. Such crimes of universal jurisdiction can be directly prosecuted in US courts. Nor would the UN likely invoke the UNHQ Agreement to prevent a fugitive from justice for crimes against humanity from being arrested. But Trump, AG Blanche, and Rubio have all been complicit in the genocide in Palestine and in persecuting human rights defenders challenging it. And the Federal government can easily block Mayor Mamdani from taking principled action on this case (asserting preemption, etc.), and refuse to take action themselves. But to do so is a blatantly lawless act of complicity designed to ensure impunity for the most notorious perpetrator in the 21st Century and for the worst crimes codified in international law.

I applaud Mamdani here for being honest and admitting he does not have the legal authority to arrest Netanyahu, but that the federal government does and should. Netanyahu is a war criminal wanted by the ICC and Mamdani point blank calls on the feds to uphold the arrest warrant and arrest Netanyahu.

This bad-faith whataboutist argument needs to be tackled head on: Netanyahu is a US ally who spends a lot of time in the US (and NYC) and is wanted by the ICC. None of those things apply to Khamenei and only one of those things (ICC arrest warrant) apply to Putin, and Mamdani has already said he’d like to arrest Putin too!
