Do you mean to say that a person aggrieved by an impugned order should resort to boycotting the judicial process, rather than file an appeal against an unfavourable order? This ought to have been avoided. If aggrieved, the proper course is to follow the legal procedure.
DNA@dna

#ManishSisodia has written to Justice #SwaranakantaSharma following #ArvindKejriwal, stating that no lawyer will represent him and expressing a lack of faith in the judicial process. He said he sees little hope for justice and hinted at adopting a Satyagraha-style protest, further intensifying the political and legal tensions around the case.

@LeherSethi I agree! I was expecting too much from people sitting on constitutional positions.

#BREAKING Election duty officers move Supreme Court saying they themselves are not on West Bengal #SIR List Se Adv MR Shamshad: These are 65 petitioners who are on election duty. Their duty orders mention EPIC numbers. Now those numbers are deleted. Now the persons conducting elections cannot vote ! This is on the face arbitrary. Many not given reasons. CJI: Make these arguments before the appellate tribunal. Let the tribunal look into it Justice Bagchi: Appropriate orders will be passed by the tribunal .. this election yes perhaps they can't vote. The more valuable right to remain on the rolls shall be preserved.

Political Party is the "superior" body. The Legislature Party is merely its "offspring." Letter from the "offspring" (the 7 MPs) cannot be used to declare the "parent" (AAP) as merged Chairman is legally bound to verify if the AAP Executive actually passed a resolution to merge

@sanket Paragraph 4(2) cannot exist in a vacuum; it is a qualifier to 4(1), not a substitute for it. The wording in Paragraph 4(2) is: "the merger... shall be deemed to have taken place if, and only if, not less than two-thirds... have agreed."

This is what the law says on merger. Para 4 Schedule 10. AAP will highlight Para 1. Raghav Chaddha + 6 and BJP will highlight para 2.

@sanket Even in the Maharashtra judgment (2023), SC made it clear: Legislators cannot hijack the party and claim legitimacy. The political party outside the House remains central to determining a valid merger.

@sanket Exactly! Even the Supreme Court in Shrimanth Balasaheb Patil (Karnataka, 2019) & reiterated in Subhash Desai (Maharashtra, 2023): The “merger” exception must be interpreted strictly to prevent abuse of the anti-defection law.

The term 2/3rd has been much widely used these days. Remember: 1. 2/3rd was required to pass the 131st Constitutional Amendment Bill, 2026 2. “2/3rd” Members of Parliament from AAP joined the BJP. Ironical.

@seemay This is what happens when parties reward Rajya Sabha seats for short-term gain. Loyalty is rare—and the result is a monumental loss in Parliament.

This is what happens (Rajya Sabha split) when you appoint commercial people for short term gains and in return elevate them with a Rajya Sabha seat! No ideology!, No Ground work!, No connect with the People! @SanjayAzadSln @ArvindKejriwal
