Some news: As @BrianLeiter reported on Friday, I will be joining the faculty at @StanfordLaw in January. I've had a wonderful time at @BerkeleyLaw since I arrived in 2019, and it was a hard decision to depart. But I'm really looking forward to joining the community at SLS.

For reasons best known to themselves, Sai Prakash + Aditya Bamzai have been selling false descriptions of my work on Art II. Most generous view: they've never read past the abstracts. But now they've doubled down. And other responsibilities trump the obligation to be kind. 1/🧵

@HoffProf @derektmuller And aren’t all ABA requirements-like that of any accreditation body-“unfunded mandates”? I don’t get that critique, though certainly some of these proposals seem really expensive.

@HoffProf @derektmuller I do think it’s worth exploring whether “experiential” course formats captures what the proponents think needs to be addressed.

@HoffProf @derektmuller Lots of good questions here, though I do think it’s fair to think that the initial 6-unit requirement was so modest as to barely move the curricular needle.

I’m not unsympathetic. However, part of the reason they get academic credit is because it’s supposed to be a pedagogically beneficial intellectual exercise. If the relationship is simply transactional, then pay editors like RAs— but then faculty should make editorial decisions.

@zazuch1 @dandakich @mwass67 Again, what M is accused of violating is the same-season in-person scouting rule. That rule is unrelated to sign stealing - in fact it is intended to minimize costs. If M broke the rule, then there should be a penalty. But any advantage gained over legal game tape seems dubious.

@ProfPolkWagner @dandakich @mwass67 Dear lord how can so many of you get this wrong by conflating incorrectly. Sign stealing done IN GAME while playing without technology is allowed. Filming a teams signals in person weeks in advance multiple times to gather their signals IS NOT allowed.

No matter which side you’re on this is the best explanation you’ll hear of why college football sign stealing matters.. Urban Meyer explains 'huge advantage' Michigan's alleged sign-stealing would have for Wolverines | Fox News foxnews.com/sports/urban-m…

@mwass67 @dandakich Okay but that’s not what Urban says. He says having an opponent’s signs is a big advantage. Which is - of course - why all the teams do it. Not to mention it is trivial to evade (with wristbands, for example.) The original post is highly misleading. 🤷🏼‍♂️

@HoffProf I’m guessing they have concerns that the reputational costs of fighting the buyout that they drafted will be major - they want to get a top coach, and they don’t have a lot of leverage. And also they may not be particularly resource sensitive. 🤷🏼‍♂️

A $76M buyout (plus the tens of millions that will be spent to recruit and hire a new coaching staff). But obviously, we shouldn't ... you know, pay the players. That would sully the purity of the college game. 🙄 🤦🏻 espn.com/college-footba…

@HoffProf @danielledonfro Why unenforceable? Contrary to state laws allowing free transfer of private property? Or against public policy because it’s anticompetitive? Both?
