“Marriage is a partnership of equals, not a service contract.” In a significant ruling, the Bombay High Court said a wife refusing or being unable to cook, clean, or do household chores cannot be called “cruelty” and grounds for divorce. The court also observed that wives are not “deemed maids.” The case dates back to a 2002 marriage where the husband accused his wife of not cooking, disobeying his parents, and causing mental stress. A Family Court had earlier granted him divorce. But the High Court overturned that decision and directed him to pay ₹20,000 monthly maintenance to his estranged wife. The judgment has sparked a bigger conversation: Should household work still be seen as a woman’s responsibility alone? Or is marriage finally being recognised as an equal partnership?
