I'm not sure we have adequately focused on how dangerous it will be to have a prez Trump who: 1) Knows he has criminal immunity for acts that can be characterized as "official" (such as ordering the military to act); and 2) Knows he has a Congress that will never impeach him.

Regs say he must file a confidential report with the AG when his work is done. One option would be to prepare a report and give it to Garland before Jan 20. Garland could then make it public. At least that would document the facts for history.

@joncoopertweets He will be allowed to remain free pending appeal. If convictions are affirmed on appeal federal courts will step in and say NY can’t jail him until he leaves office in 2029.

So, legal Twitter -- am I wrong? Did Elon jump from the frying pan to the fryer? To avoid being classed as a lottery, his lawyer said that the stuff Elon said publicly about the lottery was a lie -- that his offer was really just the chance to apply for a job. /1

@RDEliason Should you indict cases that you don't think you can win at trial in the next four years? You're not going to be able to get Trump in court as a witness, and that's going to be required b/c of confrontation clause issues if you're trying to get in anything he said.

If Smith was planning on indicting Trump's co-conspirators in DC at any point, he should go ahead and do it now. Get it on the record that the grand jury believed they should be indicted and make Trump order dismissal of the case and/or pardon them all.

Clearly a sitting president can’t be prosecuted. But that doesn’t mean this DOJ need dismiss the Trump cases rather than just putting them on hold. Of course, the Trump DOJ would dismiss the cases. But don’t do it for them.
