If you were trying to flesh out the process, then good, we’re on the same page: there’s a standard, evidence, exceptions, and an actual adjudication. My point is exactly that – our law builds in a right to apply and be heard. I’m not being defensive, I’m refusing to let “they’re illegal, no rights” sneak back in dressed up as legalese.

Right, and none of what you just wrote contradicts what I said. Yes: asylum has a legal standard (well-founded fear), a 1-year filing rule, and exceptions for “extraordinary/changed circumstances.” You don’t need CSI-level “proof,” you need credible evidence and testimony, which is exactly what the individual process is for. All of that still means the same thing: our law gives people the right to apply, be heard, and win if they meet the standard. It does not say “you crossed the border, therefore no rights, no hearing, automatic boot.” The fact you’re listing the details of the process just proves my point that the bumper-sticker version of the law you’re defending is fiction.

@RuthAnnCopenha1 @GovRonDeSantis That’s not how our own law works. Under U.S. law, if you fear persecution you can request asylum whether or not you crossed at a checkpoint. Then an individual process decides if you can stay. “Came here illegally = automatic exile” is a bumper sticker, not the rule of law.
