Citizens Alliance of North Dakota is suing the state to protect free speech. We’ve filed a federal lawsuit challenging ND’s “corrupt practices” law (NDCC § 16.1-10-04) — a vague statute that criminalizes political speech deemed “false, deceptive, or misleading.” This law has been a weapon for establishment RINOs to silence conservative voices: ➡️ In August 2025, convicted Rep. Jason Dockter sent a cease-and-desist letter over our billboard exposing his ethics violations. ➡️ Former Rep. Jeremy Olson threatened litigation after we revealed his sexual assault on a legislative staffer. ➡️ Back in 2024, accusations under this statute flew when we highlighted Rep. Todd Porter's support for sex transition surgeries on kids and Rep. Pat Heinert's vote for explicit images in elementary schools. These attacks show how the vague, overbroad rule chills free speech and forces patriots to self-censor. The 8th Circuit Court of Appeals already struck down similar laws in 2014's 281 Care Committee v. Arneson, proving core political speech can't be criminalized. Our lawsuit argues this statute fails strict scrutiny and harms far more than it helps. We're seeking declaratory judgment, injunctive relief, and damages under 42 U.S.C. § 1983 to end this threat once and for all.
