Random thought, but one reason why law schools assign so many cases, it seems to me, is that legal argumentation is in significant part a cultural practice. You have a legal culture in which certain arguments seem persuasive because the culture sees them as persuasive, and the decisionmakers are part of the culture. Depending on the court, or even the judge, there will be a certain role of text, or precedent, or reason, etc.. To make good arguments, you have to internalize that culture, and you can get there by reading a ton of cases in which judges are writing in ways that reflect (and in some cases, shape) that culture.

I was reminded of a case comment I wrote as a 2L. Yikes. Among other major problems, I had 4 footnotes *in the first sentence.* Dear Law Review world, my apologies for that monstrosity (albeit 28 years too late). On the bright side, no one has ever read it.

@OrinKerr I remember reading an interesting paper on an IT-law subject that was let down by the title: something that mimicked a mathematical expression using superscript and subscript terms. Databases mis-indexed it, I had trouble citing it in a paper because of typography limits, etc.

One problem with making jokes in law review article titles is that people rely on titles to know what your article is about. You might be in stitches over your title, but it's making it harder for your readers—and probably less likely they'll spend their time trying to read it.

@snoozrooz @OrinKerr @PNW1983 I used to use names from well known situation comedies like one of my law school professors... until I realised that almost none of my students had ever watched the shows. So now it's Andy Alpha at Propellor Pockets Ltd buys Widgets from Bravo Boys Incorporated, etc.

@OrinKerr @PNW1983 I mean, thinking about Corporate governance is one thing if you plug in Jim, Sally, Bob and Fred. It's another if you plug in specific characters from well-known shows; people as "real" people can be considered. Again, easier in the days of greater common viewership.
