...We will have to wait for the punitive figure, but that figure is effectively tethered to the compensatory figure under controlling case law. The immediate result is likely to be a stampede to the courts by plaintiffs. However, substantial questions remain for appeal.

Have you ever heard of soup beans? When I was growing up in WNC, Mamaw and Papaw made meatless suppers once or twice a week. Those meals usually consisted of soup beans seasoned with pork and various sides: fried taters with onions, cabbage, boiled taters, fresh sliced maters, homemade canned green beans, fried green maters, ramps, or wilted lettuce. You never knew what sides would show up on the plate, but there would always be a variety—and the meal was guaranteed to come with a slice of cornbread. Daddy liked his soup beans with a spoonful of mayo on top. Mamaw took hers with diced raw onion. Papaw doused his with Texas Pete. I don’t know what made me think of soup beans today… I think I’m craving them. Which is weird. I ate so much of them during hard times that they started turning my stomach. You don’t really hear the term “soup beans” in the eastern part of North Carolina. It makes my heart a little sad. “Pinto beans” sounds too plain. Anyone else call them soup beans? 👀

No court is going to award any damages when it is proven that the pedestrian acted like an idiot. You can sue for anything, doesn't mean you will win. Like do you think families of people who commit suicide by stepping into traffic ever get awarded anything? And no, he doesn't not when the neighbor put himself intentionally into harms way.

@SaraHigdon @Brettdasovic "Drivers may challenge the ticket ...." 🤦 A ticket is not going to stop someone from being sued. Listen, both these people were acting like jerks. But Alan Ritchson had a greater responsibility because he was on a motor vehicle....

@0ldmanGlen @Brettdasovic Why did he fly over the handlebars? Could it be because he was going too fast and couldn't safely slow down when someone was in the road? Indeed, it shows that Ritchson lost control of his motor vehicle. Which the law requires him to maintain at all times while on the road.

@SAonXbox @Brettdasovic It's literally on video that he intentionally ran in Ritchson's way, he adjusted to miss him and he moved AGAIN in the way. There is zero chance ever that Ritchson would be held responsible for that. It would set a legal precedent of everyone jumping intentionally in front.

@SaraHigdon @Brettdasovic U.S. courts (especially in Louisiana and California) have repeatedly described motor vehicles as a "dangerous instrumentality" (or "dangerous agency/instrument") and explicitly imposed a "higher" or "greater degree/standard of care" on drivers/motorists than on pedestrians.

He wasn't in a crosswalk and he wasn't doing it to get to the other side. His intention was to get in front of his bike. I looked up the residential laws that state with no crosswalk or intersection the favor shifts to the driver. It doesn't matter though because it wouldn't be a traffic accident as much as it would be traffic stupidity on the part of someone intentionally getting in front of a moving bike
