On substance, we are concerned about the possible impact of the proposals on #AccessToJustice and do not find satisfactory the explanation the consultation paper provides for the impact of the proposals on #OpenJustice.

The opportunity to reflect upon how court users participate in the judicial process is a welcome one. But we are concerned that the consultation process does not appear to have engaged everyday court users.

It has been brought to our attention that an individual has been describing themselves as a board member of SCOLAG in promotional material for the upcoming Scottish election. This is inaccurate and the person in question, Mark Whittet, ceased to be a director in 2013.

Reforms to the use of statement evidence are in danger of passing with inadequate scrutiny. We have real concerns over their impact on fairness of trials and the risk of miscarriages of justice. @HumzaYousaf @liamkerrMSP @JamesKellyLab @Liam4Orkney @JohnFinnieHI

Removing jury reforms from the Bill is the right course of action. @HumzaYousaf is to be commended for taking that step. We urge @ScotGov to pause the reforms to evidence by statement, which are significant and raise real fair trial issues. Consultation on them is essential.

.@HumzaYousaf should today pause the proposed reforms to juries and statement evidence. No one has explained why these changes must be made right now. There is time to consult with stakeholders. We recognise the scale of the problem and want to contribute to better solutions.

@DonaldJamesNic1 .@SCOLAG1 agrees. We do not think that this weighing up can properly be done by tomorrow. There is no reason why the Government cannot allow for a brief period of reflection, and, should it maintain its desire to pursue this path, return with further legislation.

@SCOLAG1 There is a lot of weighing up to be done. Eg how valuable are the rules (eg hearsay) and institutions (eg jury) being suspended in the first place? What price putting justice on hold for weeks and perhaps months (justice delayed is justice denied)?

There may be a case for reforms to the jury system. SCOLAG is strongly opposed, however, to rushing through such reforms in one day. These significant measures require proper scrutiny. @scotgov should remove the jury reforms from the Bill and urgently engage with stakeholders.
