Update on the Anti-homosexuality act Appeal Hearing The Supreme Court of Uganda has scheduled the hearing of the appeal challenging the Anti-Homosexuality Act 2023 for 31 March 2026 at 10:00 a.m., according to official court directions issued by the Registrar. While the outcome remains in the hands of the Court, the hearing is a reminder that efforts toward justice for the LGBTQ community continue.

Adeke’s Bill Proposed National Sex Offenders Register Adeke in clauses 31 and 32 had proposed the establishment of a sex offenders' register that was to be managed and maintained in electronic or other form by the National Identification and Registration Authority, where a person convicted of an offence under this Act shall have his or her particulars entered in the register. However, the Bill stipulated that an appeal lodged by the convicted person shall not act as a bar to the registration of the convicted person in the register, however where a conviction is quashed or overturned, the court shall, within ten days of that judgment, forward particulars and a certified copy of the judgment to the National Identification and Registration Authority for rectification of the register. Govt Concerns Over Duplicate Laws Lead to Withdrawal of Sexual Offences Bill The move followed an announcement made by Speaker of Parliament, Anita Among who informed Parliament that Government had reservations about the Bill because the proposals made in The Sexual Offences Bill, 2024 were already criminalised in many existing laws. She noted, “It has emerged that government has reservations given that the object of the Bill is defining and criminalising sexual offences, which is already covered under the existing laws. To conserve time and effort, I will ask the sponsor of the Bill, who was Anna Adeke and who has delegated Flavia of Kasanda to bring a motion of withdrawal.” Photo by @Parliament_Ug

Adeke Withdraws Sexual Offences Bill Over Conflicting Views The Sexual Offences Bill, 2024 was withdrawn from Parliament, with the mover, Anna Adeke (Soroti Woman MP) citing fears that the varying views received during the consideration of the Bill threatened to alter the objectives of the Bill. The decision to withdraw the Bill was pronounced by Flavia Nabagabe (Kassanda Woman MP), who moved the motion to have the Bill withdrawn, on behalf of Anna Adeke (Soroti Woman MP) during the yesterday’s plenary sitting. Opendi’s Bill Proposed Life Sentence for Fertility Doctors Who Use Own Gametes Without Consent In clause 30, @HonOpendi proposed imprisonment for life to be imposed on medical practitioners who use their own gamete or embryo without consent while providing human assisted reproductive technology services to the person. While in clause 31, Opendi also proposed to bar a registered medical practitioner from implanting a human admixed embryo or any other embryo that is not a human embryo into a woman’s uterus, with the registered medical practitioner found acting in contravention of this provision to be convicted to imprisonment for life. “It is alleged that the suspects have been staying together in one room… many girls ladies normally congregate to stay at the suspect’s residence..” more than the criminalization of the (sexual) liberty and choices of a certain group of adults, the subjectivity and arbitrariness that the AHA allows our so called law enforcers should worry everyone. Because what do you mean you’re arresting two girls because they have been sharing a room or their other girls congregate at their houses? Don’t people of the same sex live together all the time? In fact, it’s seen as inappropriate, especially in Uganda and Africa for people of different sexes to be housemates or roommates unless they are a couple. This might become away of settling personal scores. I just tell a homophobic society and police that I suspect you of engaging in “queer and unusual” activities and you are arrested and shunned by the community. monitor.co.ug/uganda/news/na…

WE CALL UPON AUTHORITIES TO: 1. Refrain from arresting individuals on the basis of perceived sexual orientation or gender identity. 2. Ensure that any arrest is grounded in a clearly defined offense and recognized under the law. 3. Uphold due process, including access to lawyers, next of kin, family members etc, to the accused persons. 4. Observe basic rights of suspects upon arrest, including coercion, arbitrary arrests, media outings, and torture while in detention. 5. Hold such officers and people in authority who orchestrate such acts with impunity.

Brief facts. On Wednesday the 18th, two women Wendy Faith (22) and Alesi Diana Denise (21) were arrested and detained at Onduparaka Police Station. Police reportedly received a report from social media alleging that the two women were kissing. Following their arrest, police officers visited their home to conduct a search. They also went to a photo studio where the women were suspected to have taken the photos and confiscated equipment from the studio. The women are still being held at Onduparaka Police Station. Although they were taken to Arua Central Police Station (CPS) for interrogation, they were later returned to Onduparaka Police Station, where they remain detained.
