@NFTWannabe Best wishes for a good result. Sucks that you are in Arizona, the laws are a little tougher there than most states. Corporations are pushing to criminalize what should be civil matters and they are winning.

@NFTWannabe the actual defendant. You can write your own motions and give them to your lawyer. Like make sure you have the police report from the accident and include it. Again, paid or not, don't rely on a lawyer, do the groundwork, they aren't the one facing jail. ⤵️

Looking for some guidance on a variety of topics spamming criminal legal issues, insurance billing, and automotive repair. Hopefully someone out there in crypto art is knowledgeable on some of this stuff because I feel really powerless right now and it's gotten to the point I'm so overwhelmed I am having multiple panic attacks a day.
So here is my dilemma: I am facing a $11,500 bill for damages in a rental car I rented to go to a medical appointment in salt lake city, along with up to two years in jail because it wasn't returned on time. The car was already overdue when I struck a deer that ran in front of the car on my way back to Arizona. I was travelling approximately 75 mph, it was night, and there was literally nothing I could do to avoid hitting it. It caused significant damage to the vehicle. The rental car company filed a police report after 72 hours overdue, unbeknownst to me. (I incorrectly believed that it only became a criminal offense once you were at 30 days late).
I was sleeping in the car at a park a few miles from the rental location a day or two after finally making it back to Phoenix, when I woke up surrounded by police. I was charged with failure to return a rental vehicle which is a class 5 felony.
At my first court date, I was offered a plea of 6 months in jail. The prosecutor mentioned that I had not paid the damages, and that the car was uninsured at the time of the collision. I was only given the option to take the plea, or to plead not guilty and potentially face up to two years in jail if convicted.
I have met with a public defender who doesn't seem to care about my situation at all and just says I should take the plea. I cannot afford a private attorney, am currently homeless, and have zero money. I did consult with a private attorney who said that my best course of action would be to get the damages paid for and to show a desire to the court to fix the situation.
It's highly doubtful I can come up with the money, every avenue I have tried so far the universe has laughed and said "haha try again idiot". Today I began actually looking through the invoices and it really feels like I'm being screwed there too.
First, is the storage and towing. The original company that did the towing when I was arrested charged a total of 299 dollars. The company that towed from the lot to the repair facility, billed 480 dollars but included the 299 charge from the first towing company. I am being billed 915 dollars for towing. As far as the repairs, the cost for the parts seems to be twice what is charged by mitsubishi parts. I am guessing they are allowed a markup but is that normal? I am also being charged 519 dollars for loss of use. Oh and they also managed to overdraft my debit card for 2k and my bank account was closed as a result. When I called the place billing me they said it's a non negotiable bill and did not explain the towing discrepancy.
So here are my questions with anyone who is knowledgeable in any of these areas:
Does it matter that I had no idea I was in violation of the law being late with the rental? I was never given a physical contract and the pad with the contract was on a tiny little electronic handheld thing that she just told me to sign.
Does it do any good to try to actually present to the court any extigant circumstances? Like that I was using the vehicle to go to an immunotherapy appointment? That I hit a deer which is an unavoidable accident not caused by negligence? I don't think the court will have any sympathy for the fact I'm homeless or for the fact that the real reason I hadnt immediately turned the vehicle in after returning was a combination of anxiety and the fact it was 110 degrees out every day and my dog was doing very poorly in the heat. having the air conditioning was more or less the only lifeline I had to make sure my dog was ok.
Do I have any power to try to question the billing of the insurance company or repair facility, or do I just have to pay it?
