They absolutely should. That's like saying people shouldn't have to put in TOS that they can't resell the art cause "common sense says you obviously shouldn't".
It's common sense people would do this, so it's common sense that when you run a BUSINESS, you should be updating your tos when the times start changing.

I find people who seriously complain about nerfs kinda annoying, but I find it even more annoying when the 'nerf' in question is an optional toggle with both an easier + harder mode and people still whine about it.
