The formation of SPCA committees is a statutory requirement under the Prevention of Cruelty to Animals Act, 1960, with compliance expectations strengthened through judicial pronouncements of the Supreme Court of India. This is not policy innovation, but implementation of an existing legal mandate that has remained largely unfulfilled. The real concern is whether these committees will finally be constituted with independence, transparency, and merit, as intended by law — or continue to be influenced by patronage. Without structural integrity, the objective of preventing animal cruelty stands defeated. FYI SPCA Establishment & Regulation Rules, 2001: Under Section 38(1) of the Prevention of Cruelty to Animals Act, 1960, the central government enacted these rules, mandating that state governments establish an SPCA for every district. Supreme Court Involvement: Due to slow compliance, the Supreme Court in 2008 ordered states that had not yet constituted State Animal Welfare Boards and SPCAs to do so within three months.
