Overall this is definitely an egregious example. Although I don’t think he should have been jailed, he absolutely pushed the legal limit for free speech.
I’d imagine his “support” for world wide Jew hunt made his defence difficult.
There’s plenty of cases in Europe that were far less “severe” in terms of speech used that resulted in jail time.
Not really the case in Canada as far as I’m aware

Deserves morally? Yes.
Do I think hate speech should be illegal? Probably not ideally but only if there is a strong right to bear arms. Otherwise they are probably needed. It's more a question of Canadian Constitution.
That said seems like some things here (would need to review full court records) might be illegal regardless like incitement for a pogrom and harassment.

No the law cannot be enforced at will anymore than literally any other criminal law can be.
Paulin's conviction had very little to do with the Holocaust, and more to do with saying Jews should be killed and hunted. If you have an issue it's with hate speech laws not Holocaust denial laws.

I don't see anything here about asking genuine questions being illegal. The law itself makes it clear good faith questions are legal. Legitimately debating history is in the publics interest.
