We should really be asking some critically pertinent questions in this Country, and I say this passionately as a patriotic Nigerian who means well for this Country. How come the the wife of the President, Mrs. Oluremi Tinubu has this unprecedented access to huge funds to give for “give away” charity while the ministry of health and the ministry of Interior suffer lack of funds for capital expenditure? And so many other ministry with zero disbursed allocations per their budgets. Although I commend her good works so people don't think this vital observation is made from bad blood. No, I am merely posing critical questions to Nigerians. How does the wife of the first lady have more access to funds than most MDAs who ought to serve the generality of Nigerians? How are we not asking these questions and probing this obvious disparities? How are we not disturbed as a people when a lot of contractors are not being paid and many ministries do not have access to funds to carry out their statutory obligations to Nigerians? I don't know if it is her personal funds she's been giving out — 1 billion naira here, 2 billion naira there, 500 million naira, and all sorts. All of this while MDAs cannot carry our capital expenditures that would benefit the larger populace. Again, as good as the projects may be, the wife of the President who doesn't have any Constitutional role, whatever she is doing is regarded as charity. Where is this money coming from? It is important that the Government releases funds to agencies whose statutory duty is to the people. It is disturbing when contractors who have used personal funds to execute government projects are not being paid what is due to them. Is it that the Government is telling Nigerians they cannot provide finance despite the acclaimed removal of fuel subsidy and other subsidies? You cannot gloat to Nigerians of having more money as a result of removel of subsidies and still cannot provide requisite project funds to MDAs and pay contractors. Some thing isn't adding up, I'm afraid!

I started work as a volunteer and I was assigned various important tasks, which by the grace of God, I accomplished successfully. After 3 months, I was engaged fully as Program Officer and later, I rose to become a Manager. One thing that has kept me in admiration of His Excellency is his ability to remember people and call them by their names. After my first meeting with him, he has never missed the name "Terna". This means a lot, particularly within our existential reality. By November, 2019, I wanted to open a Restaurant and Bakery in Kaduna; I told Her Excellency about it and she supported in an uncommon way. In fact, she was there with some Commissioners to perform the opening ceremony and she spoke well of me before my guests. In February, 2020, I was done with my PhD course work and I came back to report and appreciate Her Excellency for her support. It was at that point that she encouraged me to go into lecturing and facilitated my appointment as a lecturer with the Kaduna State University, Kaduna through a meritorious process. I just randomly remembered the case Olisa Agbakoba had with the DSS and how it later turned out to be one of the most outstanding landmark decisions of the Supreme Court. Let me tell you an interesting story. Sometime in 1992, Dr. Olisa Agbakoba (SAN), a prominent human rights activist and President of the Civil Liberties Organisation (CLO), arrived at the Murtala Mohammed International Airport in Lagos to board a flight to The Hague, Netherlands, where he had been invited to attend an international human rights conference. Before then, he had become one of the fiercest critics of General Ibrahim Babangida's regime over its human rights abuses and arbitrary detentions. As Dr. Olisa Agbakoba prepared to board his flight, officers of the State Security Service (DSS) intercepted him, seized his international passport without giving any reason, and prevented him from traveling. He made several attempts to retrieve his passport from the DSS, then led by Chief Albert Horsfall, but all efforts proved unsuccessful. Left with no other option, he approached the Lagos State High Court to enforce his fundamental rights. Justice Akinboboye of the Lagos State High Court heard the case and dismissed it. What was the reason for the dismissal? According to the judge, holding an international passport was merely a privilege, not a constitutional right. Unwilling to accept that decision, Olisa Agbakoba appealed to the Court of Appeal. After reviewing the case, the Court of Appeal ruled in his favour and ordered the DSS to return his passport. The DSS refused. Instead, it appealed to the Supreme Court. The DSS and the Attorney-General of the Federation, Chief Clement Akpamgbo (SAN), argued that every Nigerian passport clearly bears an inscription stating that it remains the property of the Federal Government and may be withdrawn at any time. They further argued that the issuance or possession of a passport is an exercise of executive discretion and a privilege granted to a citizen, not a fundamental right expressly guaranteed by the Constitution. Olisa Agbakoba, on the other hand, presented an outstanding argument. He argued that every Nigerian citizen, under Section 38 of the 1979 Constitution, now Section 41 of the 1999 Constitution, has a constitutional right to freedom of movement. He further argued that the constitutional right to leave and enter Nigeria cannot be practically exercised without an international passport. Therefore, the right to hold a passport is a necessary and inseparable part of that constitutional freedom. He also convinced the Supreme Court that under Section 5(1) of the Passport (Miscellaneous Provisions) Act, only the Minister of Interior has the legal authority to withdraw or cancel a citizen's passport, and even then, such power can only be exercised on grounds such as fraud, expiration, or specific public interest. The Supreme Court, in a judgment delivered by Justice Mohammed Lawal Uwais, carefully considered the arguments and sided with Olisa Agbakoba. According to the Supreme Court, the constitutional right to travel abroad cannot be effectively exercised without a passport. Therefore, an unjustified seizure or denial of a passport amounts to a direct and unlawful violation of a citizen's constitutional right to freedom of movement. The Court further explained that, under the Passport Act, only the Minister of Internal Affairs possessed the legal authority to withdraw or cancel a passport, not the DSS. The DSS, therefore, acted completely ultra vires—beyond its legal powers—by arbitrarily seizing Dr. Agbakoba's passport. In the end, the Supreme Court ordered the DSS to immediately return his passport. Till today, that judgment remains one of the most celebrated constitutional decisions in Nigeria. Lawyers still cite the decision as Director of State Security Service & Anor v. Olisa Agbakoba (1999) 3 NWLR (Pt. 595) 340. I am Ekene Aninze, Esq.

I have lost faith in the Nigerian Bar Association as professional association of lawyers. Credibility, objectivity, honesty and integrity have all departed from the NBA, affairs of NBA and the politics in NBA, unfortunately. NBA is now populated with lawyers, except few, who engaged in mob actions and talks, and lawyers who do not see anything wrong with the glaring wrongs, which wrongs even the blind can see. The most annoying thing to me is the hypocrisy of some of the most vocal legal practitioners who see wrongs and complained of wrong doing on daily basis against decisions and actions of government institutions, which decisions and actions are always taken and or done in breaches of due processes, including decisions of INEC, but did not see anything wrong with the processes of the just concluded NBA coronation. Nigerian lawyers should just keep quiet when due processes are violated in the society because the affairs of NBA are not transparent. These sets of lawyers did not see the incompetence and the illegality in the composition of ECNBA and even the lack of independence of the so- called ECNBA.These lawyers could not see that the ECNBA was teleguided to produce a pre-determined outcome. It is sad that NBA has lost everything noble. Lawyers who did not vote are far more than the lawyers that were alleged to have voted. The processes agreed to be used were jetisoned for processes to produce who the cabals want. The legal profession is going to be the worse for this. Shame on those who see nothing wrong with the wrongs that were done in all the processes that culminated in the coronation just concluded. For me I have also lost faith in the honesty and integrity of those who were very critical and threatened fire and brimstone over the glitch in the INEC viewing portal then. These same sets of lawyers are now excusing the glitch in the NBA portal that clearly showed incompetence and or a pre- determined system to favour their coronated president. These NBA elections opened my eyes to apprecaite how hollow and shallow most of the people who pontificate and called politicians names are. Any credible election is determined by the credibilityof the processes leading to election. In this year NBA election every stage of the processes leading to the sham coronation was staged managed and biased to produce the sham outcome in the just coronation by the kingmakers at NBA house. So sad.

I see some people criticizing the outcome of the ongoing NBA national election and calling for a return to the delegate system or introduction of physical voting. To put things in perspective, the winners of the NBA presidential elections since 2014 have polled as follows: 2014 – Augustine Alegeh, SAN: 691 votes (under the now abolished delegate system) 2016 – Abubakar Balarabe Mahmoud, SAN: 3,055 votes 2018 – Paul Usoro, SAN: 4,509 votes 2020 – Olumide Akpata: 9,891 votes 2022 – Yakubu Chonoko Maikyau, SAN: 22,342 votes 2024 – Mazi Afam Josiah Osigwe, SAN: 20,435 votes Whatever the flaws of the ongoing NBA election, the calls to return to the erstwhile delegate system are misplaced. That would amount to a return to the dark ages. The NBA’s universal voting system has significantly expanded participation, making our elections more inclusive and representative than they have ever been. The focus should therefore be on improving the integrity, transparency, and efficiency of the current process, not abandoning it altogether. NBA elections are becoming more popular. May the best man or woman always win.

Yesterday, the 16th day of July 2026, an emergency NEC meeting of the NIgerian Bar Association, NBA, was called by the President of NBA. The sole agenda was the NBA 2026 elections. About 256 lawyers attended the meeting. I attended the meeting. The delibrations at the meeting were combative, emotionally laddened with partisan dispositions, and in the processes most contributions were not based on issues but on emotions, which becloud the visions of most of those who made contributions to say that NBA should proceed to hold elections on the 18th of July 2026. Let me say that the worst peace is better than the best war. What struck me and stood out in that meeting was that the meeting as called was emotionally charged and directed to focus at one direction, that did not look at issues affecting NBA, with such maturity of objectivity, candour, honesty and reasonable purposes expected of legal practitioners who ought to be the light of the society. In my honest and firm view the Nigerian Bar Association stands at a critical juncture. Its strength has always rested on the confidence of its members, the integrity of its processes, and the moral authority of its leadership. Those foundations must never be taken for granted. If our leaders fail to speak with objectivity, fairness, and courage, and instead allow self-interest and partisanship to shape NBA elections, the Association risks suffering damage from which recovery may be exceedingly difficult. Institutions are weakened not only by wrongful acts, but also by the silence of those entrusted with their stewardship. I choose to speak out even in the face of intimidation and persecution. I stand with those who demand free, fair and credible elections in NBA. The NBA must remain an institution where principle prevails over personalities, where transparency triumphs over expediency, and where the collective interest of the legal profession is placed above individual ambitions. This is the moment for thoughtful reflection, principled leadership, and an unwavering commitment to preserving the credibility, unity, and independence of our Association.The future of the NBA depends on the choices we make today. Let us choose integrity over partisanship, service over self-interest, and the enduring values of the legal profession over fleeting electoral victories. If we fail as lawyers to do what is right and avoid the current selfishness in NBA, NBA in my view may be destroyed completely. What I see people write and say out of self-serving interests make me weep for NBA. Objectivity is gone. NBA is no more what we know it for. Truth is far from us. Hatred based on self serving partisan analysis has become the stock in trade in the profession. Many people who I thought always stand for justice and truth have betrayed truth and justice in discussing NBA politics. People see wrongs but they overlooked it because of their hatred for a candidate whose offence is that he was adopted by his professional ethnic association that all the candidates submitted themselves to and to be bound by their decision. Some of the Nigerian lawyers now hate by connections. Sad I must say.

If the reports concerning the Border Communities Development Agency (BCDA) are true, then this is no longer about one disputed appointment. It is about something far more disturbing: who is actually in charge of the Nigerian Presidency? When a President announces the appointment of one person and another simply ignores that directive and carries on in office, Nigeria is no longer witnessing administrative confusion. We are witnessing a struggle for control of the Presidency itself. The BCDA episode cannot be dismissed as an isolated incident because it follows a growing and disturbing pattern. Nigerians are still watching in bewilderment, the embarrassing spectacle of the so-called phantom Presidential Foreign Intervention Promotion Council (PFIPC), a government agency that officially did not exist, yet somehow operated at the highest level of government, and conducted itself with the confidence of a legitimate institution until issues arose relating to his alleged collaboration with the President’s Chief of Staff. Taken together, these episodes reveal a Presidency steadily losing its monopoly over one of the most fundamental powers of government: the constitutional authority to appoint and remove public officers. Today, Nigerians no longer know whether an appointment announced by the Presidency is final, whether a dismissal actually takes effect, or whether someone somewhere possesses a superior authority capable of overruling presidential decisions without explanation. Effectively, Tinubu administration has become a place where official announcements compete with unofficial power, where competing interests fight over appointments and patronage. Under President Tinubu, the Nigerian Presidency, like the Nigerian economy and Nigeria’s security situation has started to resemble a system governed by the principle of the survival of the fittest. This is made even worse by a disturbing pattern of public reversals that has become the defining feature of this administration. From the hurried suspension of the Cybersecurity Levy after nationwide outrage, to the withdrawal of the Expatriate Employment Levy following resistance from investors, to repeated policy summersaults and contradictory government announcements across several sectors, Nigerians have become accustomed to a government that announces first, retreats later, and explains afterwards. A government that cannot consistently stand by its own decisions gradually loses not only credibility, but authority. Investors become uncertain. The bureaucracy become confused. Public institutions begin to test the limits of because they no longer know whether today's directive will still exist tomorrow. At this point, Nigerians deserve answers that go beyond carefully managed press statements. Who is exercising the constitutional powers of the President? Who authorises appointments? Who countermanded the President's directive at the BCDA, if indeed it has been countermanded? Who permitted a fictitious agency to masquerade as an arm of the Presidency? These are not opposition questions. They are constitutional questions. They go directly to the integrity of executive authority and the stability of our nation.
