That’s not how constitutional rights work. A constitutional right doesn’t give you a free pass to violate otherwise valid laws. For example, protesting is protected by the First Amendment. But if a protest blocks traffic, people can still be cited for blocking traffic. The fact that they’re engaged in protected speech doesn’t make the traffic law disappear. Same idea here. The issue isn’t whether someone has a right to be in a public space. The issue is whether their conduct violated the public nuisance statute. If it did, then simply being in a public place isn’t a constitutional defense.
