I have a cousin who lives in an area by law where the dogs have to get rabies vaccines every so many years. She was under the impression her dog was not getting one that was mRNA. In plain language, the court is making a policy preference to ignore the functional legal differences of the drugs to get Shriners Hospitals for Children off the legal hook by claiming that functionality somehow deprives Congress of its drug labeling laws and the right of Americans to refuse experimental drugs that Shriners and Pennsylvania were contractually bound not to mandate. The Court refused to even look at the federally binding contract! Congress regulates drugs according to labeling, not formulation. Now, under the 3rd circuit, hospitals, schools, and your boss can simply claim that an experimental drug is functionally the same as a licensed drug and mandate it, EVEN WHEN it violates the HHS contract. Under 42 U.S.C. § 262, only drugs bearing a licensed label is considered a licensed product and drugs not bearing such a label are regulated entirely different. Notably, investigational drugs are not required to maintain any approved formulation, hence the reason they are under investigation.
