He is allowed to use it as political affiliation is not a protected characteristic under the Equality Act. All irrelevant now as Wetherspoons have issued a statement: "Wetherspoon welcomes supporters of all political parties. In fact, the leaders of Reform have regularly used our pubs in Clacton and Skegness, for example. Politics can obviously raise strong emotions, and we have asked all parties to use our pubs on a social basis, rather than a political one, to maintain good order and comply with licensing obligations. In this case, as a result of the supporters’ bus being parked in the pub loading bay and filming taking place at the pub, service was refused. As indicated, Reform supporters and other political supporters are welcome, but we do ask that they help us to comply with our licensing obligations."

No, they are not protected. The right of refusal of entry or service, in relation to licensed premises serving alcohol, is grounded in several legal principles: The Right of Refusal (Private Property Rights): As the operator of licensed premises, the licensee has the right to refuse entry to any individual without needing to explain why. This principle is rooted in the fact that the premises are private property, and the licensee can choose who is allowed to enter, subject to the constraints of anti-discrimination laws. This means they don't need to provide a reason for refusing entry. The Licensing Act 2003: This law governs the sale of alcohol and the operation of licensed premises. While the Act sets out various obligations and responsibilities (like the need to sell alcohol responsibly and the requirement to allow police or licensing authorities to inspect premises), it does not prevent a licensee from exercising their general right to refuse entry to individuals at their discretion. Breach of the Peace: If any individual is attempting to enter a premises and their entry would lead to a breach of the peace (for instance, if it is likely to result in violence or disorder), the licensee may refuse entry on these grounds as well. Contractual Law and Trespass: When someone enters a private premises without the permission of the licensee, it could be considered trespassing. The licensee is free to refuse entry to any person without a contractual obligation to let them in, except where specific statutory or legal obligations override this right. What the law actually prohibits : Under the Equality Act, a business open to the public (like a pub) must not discriminate based on “protected characteristics”, such as: race, sex, disability, religion or belief, sexual orientation, age, gender reassignment or prgnancy/maternity. If refusal is based on one of those, it can be unlawful. Political party support is not a protected characteristic under the Equality Act, though. There is a protected characteristic of “religion or belief”, which includes certain philosophical beliefs. However, UK case law has set a fairly high bar for what counts. General support for a political party (e.g. saying “I support X party”) would not qualify as a protected philosophical belief. Under the Licensing Act 2003: The key concept is the licensing objectives, in particular: Prevention of crime & disorder and Public safety. A premises licence is granted subject to these objectives, and the designated premises supervisor (DPS) and licensee are expected to actively uphold them. That means, in practice, they must take reasonable steps to: Prevent violence or disorder inside (and sometimes immediately outside) the premises; refuse entry or service where trouble is likely; remove or manage disruptive or dangerous patrons; call police where necessary. Failure to do so can lead to: Licence review; conditions being imposed; suspension or revocation of the licence. The operative requirement appears in the Licensing Act 2003, Section 4(1): “A licensing authority must carry out its functions under this Act (‘licensing functions’) with a view to promoting the licensing objectives.” The relevant wording is in Section 4(2) of the Act: “The licensing objectives are— (a) the prevention of crime and disorder; (b) public safety; (c) the prevention of public nuisance; and (d) the protection of children from harm.” Because a premises licence is granted and regulated by reference to those objectives, the licensee is effectively required to uphold them. If a licensee fails to promote those objectives (e.g. allows disorder or unsafe conditions), responsible authorities (like the police) can trigger a licence review, leading to either new conditions. suspension or revocation.
